Meeting Minutes Nov. 19th, 2025

Meeting Minutes by Assistant City Clerk Pam McNemee   The Troy City Council met in regular session on November 19, 2025, at 6:00 p.m. at Troy City Hall.  The meeting was called to order by Mayor Micheal Brissett.  Council members, Cody Miller, Duane Weishaar, Kohlbe King, Tim Hanlan, and Darren Clary answered roll call.  Working Supervisor Jim Horner, City Attorney Alan Boeh, Assistant City Clerk Pam McNemee, Chief of Police Mark Alan, Jarrod Mann, Clint Peden, Harry Smith, Morgan Hinds, Dorothy Schooler, Lonnie Schooler were also present. The consent agenda was submitted consisting of the council meeting minutes of November 5, 2025; bills as listed AP checks 127462 thru 127493 in the amount of $134,639.84; AP checks 127494 thru 127498 in the amount of $17, 061.15. Motion was made by Cody Miller, second by Tim Hanlan to approve the consent agenda as presented.  Vote unanimous.  Motion carried. Resolutions of finding reviews were held for 2025-07, 335 N. Liberty, Morgan Hinds; 2025-23, 431 N. 2nd Street, Lonnie Schooler and Dorothy Schooler.   Discussion followed with the City Council, and property owners. The Council concurred to have Morgan Hinds, resolution 2025-07, 335 N. Liberty Street to regularly update the Council on progress being made to bring property into compliance. Motion was made by Cody Miller, second by Kohlbe King to give a 90-day extension to resolution 2025-23, 431 N. 2nd Street, Lonnie & Dorothy Schooler to bring property into compliance, will review at the February 18, 2026 Council meeting.  Vote unanimous.  Motion carried. The Council discussed the following items with Chief of Police Mark Alan: Proposal from MTI for three cameras at the pickleball court and parking lot; potential cameras at the Water Plant; part-time police officers; and the condition of the hardware store on Main Street. Motion was made by Kohlbe King, second by Darren Clary to purchase three cameras from MTI and have them installed at a cost of $2,100.00.  Vote unanimous.  Motion carried. Clint Peden addressed the Council concerning public notices.  Discussion followed. Jarred Mann from BG Consultants updated the Council on the Water Plant CDBG project and presented them with bids for the geotechnical engineering services for the CDBG Community Center / Baseball field project.  Discussion followed. Motion was made by Duane Weishaar, second by Tim Hanlan to approve the bid from Terracon in the amount of $11,500.00 for the geotechnical engineering services on the CDBG Community Center / Baseball Field project.  Vote unanimous.  Motion carried. The Council discussed the following items with Working Supervisor Jim Horner: easements and right of ways; tubes on properties; and equipment list for sealed bids. City Attorney Alan Boeh presented the Council with a draft ordinance for sidewalk snow removal.  Discussion followed Assistant City Clerk Pam McNemee presented the Council with the renewal for City employee health care insurance from Blue Cross / Blue Shield of Kansas for 2026.  Discussion followed. CITY OF TROY, KANSAS ORDINANCE NO. 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any accumulation of snow and/or ice upon sidewalks on public right-of-way which is not promptly removed therefrom presents a danger to all persons utilizing said sidewalks. NOW, THEREFORE, IT IS ORDAINED BY THE GOVERNING BODY OF THE CITY OF TROY, KANSAS, AS FOLLOWS: 1.  That the owner(s) of record of any real estate in the City of Troy, Kansas which has a zoning classification of B-1, B-2, B-3 or B-4 and abuts a sidewalk on public right-of-way, and the owner(s) of any real estate in the City of Troy abutting a sidewalk on public right-of-way on Poplar Street between Main Street and Park Street shall cause all snow and/or ice which has accumulated on that portion of said sidewalk abutting real estate owned by the property owner(s) to be removed therefrom within 12 hours from the time the storm causing the sidewalk to be snow and/or ice covered ends.  In the event snow and/or ice accumulates upon the sidewalks herein specified in the nighttime, removal of said snow and/or ice must be completed within 12 hours after sunrise. 2.  That the owner(s) of record of any real estate in the City of Troy which abuts any sidewalk on public right-of-way, excepting those sidewalks described in Section 1 above, shall cause all snow and/or ice which has accumulated on that portion of the sidewalk abutting real estate owned by the property owner(s) to be removed therefrom within 24 hours from the time the storm causing the sidewalk to be snow and/or ice covered ends.  In the event snow and/or ice accumulates upon the sidewalks referenced in this Section 2 in the nighttime, removal of said snow and/or ice

The Troy City Council Meeting Minutes November 5, 2025

Unofficial Minutes Written by City Clerk Pam McNemee   The Troy City Council met in regular session on November 5, 2025, at 6:00 p.m. at Troy City Hall.  The meeting was called to order by Mayor Micheal Brissett.  Council members, Duane Weishaar, Kohlbe King, and Darren Clary answered roll call. Council member Tim Hanlan and Cody Miller were absent.  Working Supervisor Jim Horner, City Attorney Alan Boeh, Assistant City Clerk Pam McNemee, Tammy Resler, Clint Peden, Kim Whitsell, Katie King, Kyle Culp, Nicole Stanton, Alexandra Stanton, John Peden, Shane Stanton, Garrett Nordstrom, and Tammy Reseler were also present. The consent agenda was submitted consisting of the council meeting minutes of October 15, 2025; bills as listed AP checks 127407 thru 127422 in the amount of $38,642.38; AP checks 127441 thru 127447 in the amount of $3,233.40. Motion was made by Duane Weishaar, second by Darren Clary to approve the consent agenda as submitted.  Vote unanimous with those Council members present.  Motion carried. Mayor Micheal Brissett open the Variance Hearing for Miles Gibson at 106 S. 4th. Miles Gibson is requesting a variance on a filed building permit for a 20’ by 40’ for a garage.  The variance is for the south side setback reducing it from 5’ to less than 1’ due to the lay of the sloping yard.  Discussion followed. Motion was made by Darren Clary, second by Kohlbe King to close the Variance Hearing for Miles Gibson at 106 S. 4th.  Vote unanimous with those Council members present.  Motion carried. Kim Whitsell addressed the Council concerning her water meter at 1134 Mineral Point Road.  Discussion followed. Nicole Stanton addressed the Council concerning expanding liquor store hours to include holidays.  Discussion followed.  Council concurred to have the City Attorney draft an ordinance to expand sales to holidays. Resolutions of finding reviews were held for resolution 2024-34, 311 S. Main Street, Tammy Resler; resolution 2024-35, 323 S. Main Street, Clint Paden; resolution 2024-37, 223 E. Chestnut Street, Joseph Orcutt; resolution 2025-04, 336 N. Main Street, Kyle Culp, and Kate King; Lonnie Schooler and Dorothy Schoolerer, resolution 2025-23, 431 N. 2nd Street.    Discussion followed with the City Council, and property owners. Motion was made by Duane Weishaar, second by Kohlbe King to give a 30-day extension to resolution No. 2024-34, 311 S. Main Street, Tammy Resler to bring property into compliance, will review at the December 17, 2025 Council meeting.  Vote unanimous with those Council members present.  Motion carried. Notice to Troy Businesses, Churches, and residential utility customers:   You have until December 15, 2025 to sign up for the 10% outside Christmas Lighting discount if you have a display of outside Christmas lights this year.  This discount will be off your electric usage from the middle of December to the middle of January, which is reflected on your February 1, 2026 billing.  Please contact City Hall (985-2101 or 985-2265), Monday through Friday, except holidays, 8:00 a.m. to 12:00 noon and 12:30 p.m. to 4:30 p.m. to sign up, you can also sign up at troykansas.com or on our City of Troy Facebook page.  Please note churches with outside displays lighted at night and businesses with Christmas window light displays on in the evenings can sign up also.

CITY OF TROY, KANSAS ORDINANCE NO. 744   SPECIAL ASSESMENT TO CONSUMERS OF ELECTRIC ENERGY FURNISHED BY THE CITY OF TROY, PROVIDING FOR THE USE OF A POWER COST ADJUSTMENT FACTOR COMPUTING CHARGES FOR ELECTRIC ENERGY SOLD AND DELIVERED BY THE CITY OF TROY, PROHIBITING ANY TAMPERING WITH AN ELECTRIC METER, PROVIDING PENALTIES FOR VIOLATING CERTAIN PROVISIONS OF THIS ORDINANCE, PROVIDING FOR A DELINQUENT CHARGE AND FOR THE BILLING AND COLLECTION OF ELECTRICAL ENERGY CHARGES, PROVIDING FOR A SERVICE FEE APPLICABLE TO ALL USERS AND REPEALING CITY OF TROY ORDINANCE NO. 723 AND ALL OTHER ORDINANCES AND PARTS THEREOF IN CONFLICT HEREWITH.   BE IT ORDAINED BY AN ORDINANCE OF THE CITY OF TROY, KANSAS, FIXING CHARGES AND THE GOVERNING BODY OF THE CITY OF TROY, KANSAS:   SECTION 1.   From and after the passage of this ordinance and publication in the official city paper, the electric rates hereinafter set forth shall be in effect for all electric energy supplied to users thereof by the City of Troy, Kansas.   SECTION 2.   Electric service shall be furnished under rate schedules provided in this section to all domestic and commercial users whose usage of electricity is not measured by capacity meter and to users whose use of electricity is measured by a capacity meter but who are not subject to being assessed a capacity charge.   A Base monthly charge of $25.00 per month which base charge shall be assessed whether-or-not the customer consumes any electric energy.   for each KWH the sum of $.145 per KWH.     SECTION 3.   Electric service shall be furnished under rate schedules provided in this section to all domestic and commercial users within the city limits of the City of Troy, Kansas, whose usage of electricity is measured by a capacity meter, sometimes referred to as a demand meter and who is, according to the terms and provisions of this ordinance, subject to being billed a capacity charge.   SUMMER RATES:    Summer rates shall be utilized in connection with the billings which follow the meter readings in the months of July, August, and September.  Under summer rates each customer whose usage of electricity is measured with a capacity meter shall pay:   (1)        $0.23 per KW for the first 100 KWHS USED; and,   (2)        $0.1325 for the next 3,900 KWHs used; and   (3)        $0.0925 per KWH for all usage over 4,000 KWHs.   In addition to the KWH charges herein set forth each consumer whose usage of electricity is measured with a capacity meter and who uses 15.1 KWs or more shall pay a capacity charge of $18.24 per KW as measured by a fifteen-minute capacity meter and calculated as provided in Section 3C of this ordinance for all KWs in excess of 15.1.   WINTER RATES.
