ORDINANCE NO. 710

AN ORDINANCE OF THE CITY OF TROY, KANSAS, ESTABLISHING EMERGENCY SNOW ROUTES, PROVIDING WHEN PARKING ON EMERGENCY SNOW ROUTES IS PROHIBITED, AND AUTHORIZING ANY VEHICLE PARKED ON AN EMERGENCY SNOW ROUTE DURING A SNOW EMERGENCY TO BE TOWED AT THE OWNER’S EXPENSE, AND REVOKING ORDINANCE 653.

WHEREAS, the Governing Body of the City of Troy, Kansas, has determined that motor vehicles being parked on certain city streets and portions thereof during snow emergencies impedes snow removal efforts and creates a safety hazard.

THEREFORE, IT IS ORDAINED BY THE GOVERNING BODY OF THE CITY OF TROY, KANSAS:

SECTION 1

That for purposes of this ordinance the following definitions shall apply:

(a) “Emergency Snow Route” shall mean and include Main Street between Myrtle Street and Poplar Street; Chestnut Street between Main Street and Liberty Street; Liberty Street between Chestnut Street and Walnut Street; Walnut Street between Main Street and Liberty Street; and such additional streets or portions thereof as are, by signs placed thereon, designated as Emergency Snow Routes.

(b) A “Snow Emergency” shall exist any time it has snowed two (2) or more inches and the emergency snow routes have not been plowed or otherwise cleared, or a snow emergency has been declared by the Mayor of the City of Troy, the President of the Governing Body of the City of Troy, or the Chief of Police of the City of Troy and notice of said declaration is posted on the front door of the Troy City Hall. If a snow emergency is declared as herein provided, such shall remain in full force and effect for so long as notice thereof remains posted on the front door of the City of Troy City Hall.

(c) “Vehicle” means every device, licensed or unlicensed, upon or by which any person or property is or may be transported, whether such device be in running condition or not.

SECTION 2

Any vehicle parked on a street designated as an emergency snow route may be towed by the City of Troy, its employees, agents or designees and all expenses associated with towing and/or storing said vehicle shall be paid by the owner thereof.

SECTION 3

This ordinance shall be in full force and effect from and after its publication in the official city paper.
