ORDINANCE NO. 705
AN ORDINANCE OF THE CITY OF TROY, KANSAS VACATING A PORTION OF ERNEST STREET IN THE CITY OF TROY, DONIPHAN COUNTY, KANSAS.
WHEREAS, the governing body of the City of Troy, Kansas has determined that vacating that portion of Ernest Street hereinafter described, to wit:
That part of Ernest Street, in Doniphan Hills Estates, 1st Plat, a subdivision of land in the Northeast Quarter of Section 19, Township 3 South, Range 21 East in the City of Troy, Doniphan County, Kansas more particularly described as follows:
Commencing at the Northeast Corner of Lot 11 in Doniphan Hill Estates, 1st Plat; thence South 1°40’55” East, a distance of 42.28 feet to the True Point of Beginning; thence along a curve to the right having a radius of 14.00 feet, with an arc length of 18.90 feet, with a chord bearing of South 37°00’23” West, and with a chord length of 17.50 feet; thence with a reverse curve turning to the left with a radius of 50.00 feet, with an arc length of 146.05 feet, with a chord bearing of South 8°00’005” East, and a chord length of 99.39 feet to the Northeast Corner of Lot 13 in said Doniphan Hill Estates, 1st Plat; thence North 1°40’55” West a distance of 112.45 feet to the point and place of beginning. Said tract contains 3956.15 square feet, more or less. Subject to all public roads, easements, restrictions, reservations, covenants, and conditions, if any, now of record. Said described tract is also subject to a blanket utility and ingress/egress easement reserved for the City of Troy for the purpose of maintenance of utilities across Lots 11-13 in Doniphan Hills Estates, 1st Plat
would assist Doniphan County, Kansas, promote beneficial use and development in the city, enhance the city’s tax base, and generally be in the best interest of the City of Troy, Kansas.
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF TROY, KANSAS:
SECTION 1. That the above described portion of Ernest Street, in Doniphan Hills Estates, 1st Plat, is hereby vacated.
SECTION 2. That this Ordinance shall be in full force and effect from and after its publication in “The Kansas Chief”, the official city newspaper.
PASSED BY THE GOVERNING BODY OF THE CITY OF TROY, KANSAS AND APPROVED BY THE MAYOR OF SAID CITY THIS 5th DAY OF June, 2018.
