ORDINANCE NO. 696
AN ORDINANCE OF THE CITY OF TROY, KANSAS, ESTABLISHING CHARGES TO CERTAIN USERS OR PROPOSED USERS OF ELECTRIC ENERGY FURNISHED BY THE CITY OF TROY, KANSAS, WHENEVER THE CITY IS REQUIRED OR REQUESTED TO PROVIDE TO SAID USER OR PROPOSED USER TRANSFORMER CAPACITY IN EXCESS OF FIFTEEN K.V.A
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF TROY, KANSAS:
SECTION ONE. From and after the passage of this ordinance all users or proposed users of electric energy furnished by the City of Troy, who require or request the installation of a transformer or transformers which individually or collectively have more than fifteen K.V.A. of capacity shall not have said transformer or transformers provided and/or installed by the City of Troy, Kansas until said user or proposed user shall have first paid to the City of Troy a sum equal to the City’s cost of all transformers, electrical equipment or supplies which the City is required to acquire in order to make said installation. Upon completion of the installation of a transformer of transformers with greater that fifteen K.V.A. of capacity, the customer served by said transformer or transformers shall promptly reimburse the City of Troy for the cost of any additional electrical equipment or supplies (i.e. that not paid for in advance) required in order to complete installation of the transformer o transformers and shall also reimburse the City for all labor expenses attributable to installation of the subject transformer or transformers. In order that labor expenses can be properly allocated to a particular transformer project, the City or some agent or employee thereof shall keep accurate records concerning the personnel working on said transformer project, the amount of time spent thereon by each employee and the amount of wages collectively paid said city employees for time spent in connection with the subject transformer installation project. The City shall be reimbursed its actual labor costs.
SECTION TWO. This ordinance shall not result in any charge to electrical user for transformer capacity now in the place, notwithstanding the fact that such may be greater than fifteen K.V.A, nor shall it result in any charge to an electrical user for replacement or repair of transformers now in place or for replacement or repair of transformers now hereafter installed and paid fro by the user. Any electrical user with more than fifteen K.V.A. transformer capacity available who requests or requires additional transformer capacity shall be assessed charges hereunder only for capacity which is over and above the capacity in place on the date hereof or is in addition to capacity hereafter acquired and paid for according to the terms and provisions of this ordinance.
SECTION THREE. The terms and provisions of this ordinance shall not affect any other ordinance of the City of Troy establishing charges for electricity or electrical equipment, rather the charges herein imposed shall be in addition to said other charges.
SECTION FOUR. This ordinance shall be in full force and effect from and after its publication in the official city paper.
