CITY OF TROY, KANSAS
ORDINANCE NO. 695
AN ORDINANCE AUTHORIZING THE SALE AT RETAILOF CEREALMALT
BEVERAGE IN THE ORIGINALPACKAGE WITHIN THE CITY OF TROY,
KANSAS ON ANY SUNDAY, EXCEPT EASTER, BETWEEN THE HOURS OF
12 NOON AND 8 P.M.; REVOKING ALLORDINANCES IN CONFLICT
HEREWITH; AND DECLARING WHEN THIS ORDINANCE SHALL BECOME
EFFECTIVE.
WHEREAS, the sale at retail of cereal malt beverage in the original package
is currentlynot authorized within the City of Troy, Kansas on Sundays; and,
WHEREAS, the sale at retail of cereal malt beverage in the original package
on Sundays is allowed in numerous cities proximate to the City of Troy, Kansas;
and,
WHEREAS, the governing bodyof the Cityof Troyis of the opinion that
prohibiting the sale at retail of cereal malt beverage in the original package on
Sundaywithin the City of Troy, Kansas is economicallyinjurious to the cityand to
businesses in the citylicensed to sell cereal malt beverage in the original package;
and,
WHEREAS, the governing bodyof The Cityof Troy, Kansas is also of the
opinion that permitting the sale at retail of cereal malt beveragein the original
package within the Cityof Troy, Kansas on anySunday, except Easter, between the
hours of 12 noon and 8 P.M. is not inimical to the City of Troyor to the citizens
thereof.
NOW, THEREFORE, IT IS ORDAINED BY THE GOVERNING BODY OF THE
CITY OF TROY, KANSAS:
SECTION 1.
That the sale at retail of cereal malt beverage in the original package within
the Cityof Troy,Kansas on anySunday, except Easter, between the hours of 12
noon and 8 p.m. is herebyauthorized.
SECTION 2.
That all ordinances or portions thereof in conflict herewith are hereby
repealed.

SECTION 3.
That this ordinance shall be published once each week for two (2)
consecutive weeks in the official citynewspaper.
SECTION 4.
That this ordinance shall become effective sixty (60) days following the date
of its publication. If, within sixty (60) days followingpublication of this ordinance,
a petition requesting that the proposition be submitted for approval bythe voters of
the Cityof Troy,Kansas is filed in accordance with the terms and provisions of sub-
section (B) (2) of K.S.A. 41-2911 then this ordinance shall not become effective
until the proposition is submitted to and approved at an election as provided in sub-
section (B) of K.S.A. 41-2911.
