ORDINANCE NO. 690

AN ORDINANCE OF THE CITY OF TROY, KANSAS, MAKING IT UNLAWFUL TO BLOW, THROW, RAKE OR IN ANY MANNER DEPOSIT OR CAUSE TO BE DEPOSITED GRASS, LEAVES, TREE BRANCHES, YARD WASTE OR DEBRIS OF ANY KIND IN OR ON ANY PUBLIC STREET, ROADWAY, ALLEY, GUTTER, DRAINAGE DITCH OR OTHER DRAINAGE STRUCTURE IN THE CITY OF TROY, KANSAS, AND PRESCRIBING PENALTIES THEREFORE.

WHEREAS, blowing, throwing, raking or in any manner depositing or causing to be deposited leaves, tree branches, yard waste or debris of any kind upon or in any streets, public roadways, alleys, gutters or drainage structures of any kind is unsightly, necessitates the expenditure of public resources to clean up, and impedes the flow of water in storm sewers, drainage ditches, tubes and other drainage structures.

NOW, THEREFORE, IT IS ORDAINED BY THE GOVERNING BODY OF THE CITY OF TROY, KANSAS.

Section 1. Unless specifically authorized by the governing body of the City of Troy, Kansas it shall be unlawful for any person to blow, throw, rake or in any manner deposit or cause to be deposited grass, leaves, tree branches, yard waste or debris of any kind upon or in any public street, roadway, alley, gutter, drainage ditch or drainage structure of any kind.

Section 2. If any person mowing grass growing adjacent to or near a public street, roadway, alley, gutter, drainage ditch or other drainage structure inadvertently causes grass to be blown or thrown onto or into said public street, roadway, alley, gutter, drainage ditch or drainage structure of any kind and immediately thereafter cleans up and removes said grass from the public street, roadway, alley, gutter, drainage ditch or drainage structure said person shall not be guilty of violating this ordinance.

Section 3. Any person found guilty of violating the terms and provisions of this Ordinance shall, upon a first conviction, be sentenced to pay a fine which shall be fixed by the Court at not less than $25 nor more than $250. If a person is convicted of having violating any of the terms and provisions of this ordinance after having previously been convicted of such violation, such persons shall be sentenced to pay a fine fixed by the Court of not less than $50 nor more than $500 and may, in addition to said fine, be sentenced to a definite term of confinement in the Doniphan County jail/confinement center which shall be fixed by the Court and shall not exceed thirty days.

Section 4. This ordinance shall be in full force and effect from and after its publication in the official City newspaper.
