ORDINANCE 683

AN ORDINANCE OF THE CITY OF TROY, KANSAS, PROVIDING THAT LANDLORDS AND OWNERS OF REAL ESTATE TO WHICH UTILITY SERVICES ARE PROVIDED ARE RESPONSIBLE FOR THE PAYMENT OF DELINQUENT UTILITY ACCOUNTS; PROVIDING FOR PAYMENT UPON TERMINATION OF UTILITY SERVICES; PROVIDING FOR THE TRANSFER OF UTILITY SERVICES TO OTHER PROPERTY; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES OF THE CITY OF TROY, KANSAS IN CONFLICT THEREWITH.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF TROY, KANSAS.

SECTION 1. LANDLORD OR OWNER OF REAL ESTATE RESPONSIBLE FOR DELINQUENT UTILITY ACCOUNTS. All landlords and/or owners of real estate (hereinafter referred to as Alandlords@) within the City of Troy, Kansas to which the City of Troy provides electric, water or sewer utility services, shall be responsible for payment for said services when the same become delinquent and are unpaid due to the failure of the tenant(s) or occupant(s) of landlord=s property to pay the charges for such utility services. When any account for such utility services shall be delinquent the landlord shall be notified in writing, personally served upon the landlord or sent to the landlord by certified mail, concerning said delinquency and advised that such delinquent account shall be transferred to the name of the landlord and become the joint and several responsibility of the landlord and the tenant at the end of seven (7) days from the date said notice was personally served upon the landlord or mailed to the landlord by certified mail unless prior to such time the delinquent charges are paid in full. The landlord of such property shall not be entitled to have the utility services placed in the name of any other individual entity until such delinquent account is paid in full.

SECTION 2. TERMINATION OF UTILITY SERVICES AT REQUEST OF USER. In the event a user of the utility services provided by the City of Troy requests the City to terminate utility services to property occupied by said user then and in that event the City shall within twenty-four (24) hours, read the meter and determine the utility charges owed by said user to the date of termination. Said utility charges shall be paid within forty-eight (48) hours from the date of the termination of such services.

SECTION 3. TRANSFER OF UTILITY SERVICES. In the event a utility user requests the city to transfer his/her/its utility serves to another property the City shall not connect the utility services to such other property until all services delivered to the previous location of said user have been paid in full.

SECTION 4. REPEALER. All ordinances or parts of ordinances of the City of Troy, Kansas in conflict herewith are hereby repealed.

SECTION 5. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, approval and publication in the official City newspaper.
