CITY ORDINANCE NUMER 643

AN ORDINANCE OF THE CITY OF TROY, KANSAS SETTING FORTH TIMES WHEN THE OUTDOOR BURNING OF TRASH, REFUSE, GARBAGE, LEAVES AND OTHER COMBUSTIBLE MATERIALS IS PROHIBITED; PROVIDING FOR EXCEPTIONS; PROVIDING PENALTIES FOR VIOLATING THIS ORDINANCE; AND REPEALING ALL OTHER ORDINANCES OR PARTS THEREOF IN CONFLICT HEREWITH

WHEREAS, smoke and odor resulting from the outdoor burning of trash, waste, refuse, garbage, leaves and other combustible materials in the City of Troy, Kansas, is particularly unpleasant and annoying when weather conditions, as often exist in the evenings, cause smoke to linger rather than dissipate quickly.

IT IS TEHREFORE ORDAINED BY THE GOVERNING BODY OF THE CITY OF TROY,

KANSAS:

SECTION 1. That except as hereinafter provided, no outdoor burning of trash, refuse, garbage, leaves or other combustibles shall occur in the City of Troy, Kansas between the hours of 5 p.m. and 6 a.m. During the period here specified any open fires started prior to 5 p.m. shall be fully extinguished by 5 p.m.

SECTION 2. The ban on outdoor burning provided for in Section 1 of this ordinance shall not apply to or prohibit the use of gas or charcoal grills or wood fires in rings, stoves or fireplaces used for the cooking of food or outdoor ambiance, or to torches used for decorating/ambiance purposes or to repel insects.

SECTION 3. Any person found guilty of violating this ordinance shall, for each violation, be fined a sum of not less than Fifty Dollars ($50.00) and not more than Two Hundred and Fifty Dollars ($250.00).

SECTION 4. Ordinance No. 625 of the City of Troy, Kansas and all ordinances and parts of ordinances in conflict herewith are hereby repealed.

SECTION 5. This ordinance shall be in full force and effect from and after its publication in the official city paper.
