CITY OF TROY, KANSAS

CHARTER ORDINANCE NUMBER 2011 – 1

A CHARTER ORDINANCE EXEMPTING THE CITY OF TROY, KANSAS, FROM K.S.A. 12-4112; PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT; AND AUTHORIZING THE ASSESSMENT OF COURT COSTS IN CASES HEARD IN THE MUNICIPAL COURT OF THE CITY OF TROY, KANSAS.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF TROY, KANSAS:

SECTION ONE: The City of Troy, Kansas, by virtue of the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to exempt itself from, and make inapplicable to itself the provisions of K.S.A. 12-4112 which are applicable to the City of Troy, but is not uniformly applicable to all cities.

SECTION TWO: In lieu of the provisions of K.S.A. 12-4112, the governing body of the City of Troy, Kansas, hereby adopts the following provisions:

Each person found guilty of a violation of the ordinances of the City of Troy, Kansas shall be assessed costs for the administration of justice and such costs, commonly referred to as Court costs, shall be determined by ordinance of the City of Troy, Kansas.

SECTION THREE: This ordinance shall be published once each week for two consecutive weeks in the official city newspaper.

SECTION FOUR: This is a charter ordinance and shall take effect sixty-one (61) days after final publication, unless a sufficient petition for a referendum is filed and a referendum held on this ordinance as provided in Article 12, Section 5, Sub-Section (c) (3) of the Constitution of Kansas, in which case the ordinance shall become effective if approved by the majority of the electors voting thereon.

Unanimously passed by the Governing Body of the City of Troy, Kansas, this 5th day of April, 2011.
