AN ORDINANCE OF THE CITY OF TROY, KANSAS, ESTABLISHING RATES FOR USERSOF WATER, PROVIDING FOR TAPS AND CONNECTIONSTO THE CITY'SWATERMAINSANDESTABLISHINGTHERATESTHEREFORE,PROVIDINGFORTHEINSTALLATIONOFWATERMETERSANDFOR· ANACCOUNTPROCESSINGFEEASSOCIATED THEREWITH, PROHIBITING THE MAKING OF INSTALLATIONS, TAPSAND CONNECTION BY CERTAIN PERSONS, PROVIDING PENALTIES FOR VIOLATINGCERTAIN PROVISIONS OF THIS ORDINANCE, FIXING DATES FOR THE PAYMENT OFWATERBILLS,PROVIDINGFORTHEBILLINGANDPAYMENTOFCHARGES,PROVIDINGFOR THE IMPOSITION OF A DELINQUENCYCHARGE AND FOR THEDISCONTINUANCE OF WATER SERVICE FOR FAILURE TO PAY BILL, PROVIDINGFORAUTOMATICFUTUREINCREASESTORATESANDCHARGES,EFFECTIVEJANUARY 1, 2023, REPEALING ORDINANCE NO. 688 AND ALL OTHER ORDINANCESANDPARTSOFORDINANCESINCONFLICTHEREWITH.

 

BEITORDAINEDBYTHEGOVERNINGBODYOFTHECITYOFTROY,

KANSAS:

 

SECTION ONE: From the date this ordinance is passed until June 15, 2021 all ratesand charges established by City of Troy Ordinance 688 shall remain applicable and in full forceand effect. Effective June 15, 2021 the rates and charges to users of water supplied by the City ofTroy,Kansas,shallbeasfollows:

 

(A)   Each user of water having a water meter serving property situated entirely orpartially within the limits of the City of Troy, Kansas, shall be assessed a monthly base charge ofTwenty-six Dollars and Seventy-Five Cents ($26.75) per water meter.This base charge shall notentitletheusertoor constitutepayment foranywater.

 

(B)   Each user of water having a water meter serving property situated entirely orpartiallywithin the limits of the City of Troy, Kansas, shall, in additionto the base charge providedforinsub-section(a)ofthis sectionpayforallwaterusedattherateof$0.00840pergallon.

 

(C)    Each user of water having a water meter serving property situated entirelyoutside the limits of the City of Troy, Kansas, shall be assessed a monthly base charge of Thirty­fiveDollars($35.00)perwatermeter.Thisbasechargeshallnotentitletheusertoorconstitute

paymentforanywater.

 

(D)   Eachuserofwater havingawatermeterservingpropertysituatedentirelyoutsidethelimitsoftheCityofTroy,Kansas,shall,inadditiontothebasecharge

provided for in sub-section (c) of this section pay for all water used at the rate of $0.00982 pergallon.


 

(E)  EachuserofwaterobtainingwaterdirectlyfromtheCity'smainswithouttheinstallationoftheusualmetershallpayforsuchwaterattherateofTwenty-FiveCents($.25)foreachfifty(50)gallonsor fractionthereof.

 

(F)  All other users not included in sub-sections (A), (B), (C), (D) and (E) aboveobtainingwater fromtheCityof Troy,Kansas,shall payfor the same at therate of $0.009870pergallon.ThisrateshallalsobeapplicabletoRuralWaterDistrictNo.5ofDoniphanCounty,Kansas,shouldit,begrantedpermissiontoobtainwaterfromtheCity.

 

(G)  In situations where a water meter has been installed for a user of water andusers in addition to the one for whom the meter has been installed are receiving water therefrom,an additional charge of Ten Dollars ($10.00) per month for each additional user shall be madewith such charge to be billed to and paid by the water meter user.For the purposes of this sub­section, "additionaluser" shallbe definedas any business,household,trailerhouse, mobilehomeor other separate water user supplied water by the City of Troy for whom/which no separatewater meter has been installed, it being the intention of this sub-section to impose an additionalchargeforwaterincircumstanceswhere severalseparateusesofwaterarebeing made,butwhere only one water meter has been installed, examples of such uses being but not limited to,mobile home and trailer parks, two-business establishments receiving water from one meter, or ahomeandaseparatebusiness receivingwaterfromonemeter.

 

SECTION TWO: All rates and charges referenced in Sections One and Three ofthis Ordinance shall automatically increase by three percent (3%) on January 1, 2023, and onJanuary1ofeachyearthereafter.

 

SECTION THREE:Any user or prospective user of water requesting the City ofTroy, Kansas, to make any connection with the water mains of the City of Troy shall, in additiontothedepositrequiredinSectionFiveofthisOrdinance,berequiredfirsttopay totheCityofTroythesumofNineHundredDollars($900.00)foreachthree-fourths(3/4)inchtaptobemade.For any larger tap an appropriate and proportionately greater additional charge shall bemadeto coverthecoststotheCity oftheinstallationofthetapandmeter.Alltapsandconnectionsto the water system of the City of Troy shall be made by the City and its dulyauthorizedemployeesandagents,anditshallbeunlawfulforanyotherpersonorpersonstomake such taps or connections.  All taps to the water system of the City shall be made at thewater main nearest to the property of the user or prospective user.The City shall lay pipe fromthe main only to the edge of the street or alley nearest to the property of the user or prospectiveuser,andinnoeventwillprovidemorethanfifty(50)feetofpipe.Anyadditionalpipeusedtoeffect aconnectionshallbeattheexpenseofthe userorprospectiveuser,andanadditionalchargetocoverthe costsof thesame shallbemadebytheCity.

 

SECTION FOUR: The City of Troy, Kansas, shall install a meter box and a meterin the same at, or as near to as is reasonablypossible, the property line of the premises to beserved.The City shall also make all connections between its water main and said meter.It shallbeunlawfulforanypersonorpersons,otherthandulyauthorizedemployeesoragentsoftheCity,tomakeanytapsorconnectionstotheCitywatersystem ortotamperwithwatermains,metersorequipmentinanymanner.


 

 

SECTION FIVE: Any person violating any of the provisions of Sections Threeand/orFourofthisOrdinanceshallbedeemedguiltyofamisdemeanorandshall,uponconviction therefore, be fined not less than Twenty-Five Dollars ($25.00) and not more than FiveHundredDollars($500.00) for each violation, andshall be subjectto disconnectionof waterservices.

 

SECTIONSIX:ThewatermetersabovereferencedshallbeownedbytheCityofTroy, Kansas, and any person making a request for connection to the water mains of the City ofTroy or for water service shall pay to the City a non-refundable account processing fee of FiftyDollars ($50.00).No water meter shall be installed or water service provided until the paymentoftheaccountprocessingfeehereinprovidedfor.

 

SECTION SEVEN: Bills for water service shall be rendered monthly and shall becalculated at the rates provided for in this Ordinance.Bills shall be dated the first day of eachmonthandifnotpaidwithinten(10)days, anadditionalservicechargeoftenpercent(10%)ofthe gross amount of the total bill will be assessed against the customer.If a water bill is not paidwithin twenty (20) days after the date of such bill, service may be discontinued.Where serviceshave been so discontinued, an additional service charge of One Hundred Dollars ($100.00) shallbepaidby theuserforre-connectionofservices.

 

SECTIONEIGHT:OrdinanceNo.688of theCityofTroy,Kansas,andallordinances and parts of ordinances of the City of Troy, Kansas, in conflict herewith are herebyrepealed.

 

SECTION NINE: This Ordinance shall be in full force and effect from and afterits publicationinTheKansasChief,theofficialpaperfortheCity ofTroy,Kansas.

 

Passed by the Council and approved by the Mayor of the City of Troy, Kansas, onthe18thdayofMay,2021.
