The Troy City Council met in regular session Tuesday September 7, 2021, at 6:30 p.m. at the Troy City Hall. The meeting was called to order by Mayor Sarah J. Boeh-Cerra. Mayor Sarah J. Boeh-Cerra and Council members Stan Ruhnke, Cody Miller, and Nick Popple answered roll call. Council members Tim Hanlan and Micheal Brissett were absent. Also present were City Clerk Jim Richardson, and City Attorney Alan Boeh.
Motion was made by Cody Miller, second by Nick Popple to approve the Council minutes of the August 17, 2021. Vote – unanimous with those Council members present. Motion carried.
The Council reviewed and discussed the bills presented.
Motion was made by Nick Popple, second by Cody Miller to approve the bills as listed AP check number 12731 thru 12765 in the amount of $19,112.49 and Utility Deposit refund check number 12730 in the amount of $27.35. Vote – unanimous with those Council members present. Motion carried.
Mayor Sarah J. Boeh-Cerra opened the Revenue Neutral Rate Public Hearing for the 2022 proposed budget. There were no citizen’s present to comment regarding the Revenue Neutral Rate for the 2022 budget. Discussion followed with Council members.
Motion was made by Cody Miller, second by Nick Popple to close the Revenue Neutral Rate Hearing for the 2022 budget. Vote unanimous with those Council members present. Motion carried.
Motion was made by Nick Popple, second by Cody Miller to approve Resolution number 2021-5 a resolution of the City of Troy, Kansas to levy a property tax rate exceeding the revenue neutral rate. Vote unanimous with those Council members present. Motion carried.
Mayor Sarah J. Boeh-Cerra opened the public hearing for the 2022 proposed budget. There were no citizen’s present to comment regarding the budget. Discussion followed with Council members.
Motion was made by Cody Miller, second by Nick Popple to close the 2022 budget hearing. Vote unanimous with those Council members present. Motion carried.

Building permits were submitted by Cydney Fansher to build a daycare center at 223 W. Myrtle and Chandra Vanwey to remove an above ground pool and put in an inground pool at 633 South Park Street. Cydney Fansher was present by phone to request that the Council grant her a conditional use of the property at 223 West Myrtle as a daycare center. Discussion followed.
Motion was made by Stan Ruhnke, second by Cody Miller to grant Cydney Fansher a conditional use of the property at 223 West Myrtle as a daycare center. Vote – unanimous with those Council members present. Motion carried.
Motion was made by Stan Ruhnke, second by Cody Miller to approve building permit 2021-6 submitted by Cydney Fansher to build a daycare center at 223 West Myrtle less the section pertaining to the driveway until further information is provided to the Council and a contract can be entered into regarding the construction, use, and maintenance of the driveway. Vote – unanimous with those Council members present. Motion carried.
Motion was made by Stan Ruhnke, second by Cody Miller to approve building permit 2021-7 submitted by Chandra Vanwey to remove an above ground pool and put in an in ground pool at 633 South Park Street. Vote – unanimous with those Council members present. Motion carried.
Mayor Sarah J. Boeh-Cerra presented the Council with the final billing for the release of retainage from R/S Electric in the amount of $44,836.20 on the phase one electrical project. Discussion followed
Motion was made by Nick Popple, second by Cody Miller to approve payment of the bill for the release of retainage from R/S Electric in the amount of $44,836.20 on the phase one electrical project. Vote – unanimous with those Council members present. Motion Carried.
City Clerk Jim Richardson presented the Council with a request from the Troy Baptist Church to close Main Street from Walnut to Chestnut on September 25, 2021, from 4:00 p.m. thru 11:00 p.m. to host a block party to include a bounce house, band, food and a movie. Discussion followed.
Motion was made by Stan Ruhnke, second by Cody Miller to allow the Troy Baptist Church to close Main Street from Walnut to Chestnut on September 25, 2021, from 4:00 p.m. thru 11:00 p.m. to host a block party. Vote – unanimous with those Council members present.
The Council discussed the following items: The Oil & Chatting done in the City of Troy; and posting for a City job opening.
There being no further business, motion was made by Stan Ruhnke, second by Cody Miller to adjourn the meeting. Vote – unanimous with those Council members present. Motion carried. The meeting adjourned at 7:19 p.m.
