Troy City Council met at Ambulance Barn due to Pioneer Center having a supper on HNovember 5, 2019 in regular session.  Mayor Robert Jenkins called the meeting to order at 6:30 p.m.   Others present were council members

Stan Ruhnke, Sarah Boeh-Cerra, Carolyn Clary, Hobert Clary, and Tim Hanlan, City Clerk Jane Boeh, and City Attorney Alan Boeh.  Others present for a portion of the meeting were Working Supervisor Jim Horner, Ambulance Director Matt McKittrick, Police Chief Doug Duncan and Kimberly Capps.

 

Hobert Clary moved to approve minutes as written for October 15, 2019.  Hanlan seconded the motion and it carried.

 

Hanlan moved to approve bill check #011320 to #011321 dated October 21, 2l019 in the amount of $17,918.88 and check #11322 to #11359 in the amount of $62,049.24.  Hobert Clary seconded the motion.  Boeh-Cerra abstained from voting on Reeder & Boeh bill.  Motion carried. 

 

Kimberly Capps, who has five dogs and who will soon be moving from the state of Washington to Troy, appeared before the governing body to request a variance from provisions of the zoning code which prohibits having more than three dogs in a residentially zoned area, or in the alternative a conditional use permit which would allow her to keep her dogs, two of which are quite old.  After discussion Ruhnke move that a temporary conditional use permit be granted, but said temporary conditional use be applicable only until the next meeting of the governing body, and that the conditions thereof be (1) that all dogs be kept in the house at all times except for such time outside as is required for a dog to relieve itself; (2) that when a dog is outside it shall be on a leash or confined in a fenced yard; (3) that the dogs will not be allowed outside the house for any reason if they are barking or engaging in any noisy conduct; (4) that none of the existing dogs will be replaced as the replacement animal would be in violation of the three dog limit.  Ruhnke’s motion was seconded by Hanlan and carried on aye votes of Ruhnke, Carolyn Clary, Hanlan and Boeh-Cerra.  Council person Hobert Clary voted nay.

 

Police Chief Duncan was given permission to have his computer backup storage thru St. Joe Business Machines at a cost of $50.00/year.  Police Chief is also going to help with the active shooter training on November 13 at the courthouse which will be closed that day from 1 p.m. to 5 p.m.

 

Working Supervisor Horner reported on the valve exercising that was done on October 29 and 30 by Kansas Rural Water Association and will schedule this to be done each year.  Horner is checking with Kansas Rural Water to see what they would charge to help clean out 13 water meter pits.  He has a bid from Engemann Drainage.

 

We have a cell in the Mesquito Creek lagoons that is plugged but are working with Engemann Drainage to get unplugged as Bud Sewer can’t come until late Wednesday or Thursday.  An incident report will be filed with KDHE so they will be aware of the problem.

 

Ambulance Director McKittrick has gotten a plumber to give him a bid on the ambulance shower project and is waiting on a bid from Brad Smith.

 

Hanlan moved to allow the clothing allowance to be the same as last year for ambulance personnel based on runs and years of service.  Hobert Clary seconded the motion and it carried.

 

Substation was discussed.

 

Hanlan moved to pass resolution 2019-3 adopting the Kansas Homeland Security Region K Hazard Mitigation Plan.  Ruhnke seconded the motion and it carried.

 

Ruhnke moved to go into executive session at 7:05 p.m. for 15 minutes to discuss legal matter.  Hanlan seconded the motion and it carried.  All left the meeting except Council, Mayor, City Clerk, Police Chief and City Attorney.

 

Meeting reconvened at 7:15 p.m. 

 

Discussion was had relative to restitution received by the City in connection with case 2018-CR-000078.

 

Boeh-Cerra moved to have city attorney contact court and make inquiry relative to amount being paid for restitution case E2018-CR-000078.  Ruhnke seconded the motion and it carried.

 

Carolyn Clary moved to adjourn at 7:16 p.m.  Hobert Clary seconded the motion and it carried.
