Troy City Council met at Troy City Hall on March 3, 2020 in regular session.  Mayor Sarah Boeh-Cerra called the meeting to order at 6:30 p.m.  Others present were council members Stan Ruhnke, Tim Hanlan, Carolyn Clary and Cody Miller, City Clerk Jane Boeh, Working Superintendent Jim Horner, City Attorney Alan Boeh, Trina Earl, Jeremy Prudden, Angie Kreider with Rainbow Communication, and Police Chief Doug Duncan.

 

Hanlan moved to approve minutes for February 18 and 26, 2020.  Miller seconded the motion and it carried.

 

Doniphan County Pet Rescue is in the process of working on getting 501 non-profit status.  Then they will be able to get grants.  For now, Trina Earl has enclosed pens at her house and working from there with animal control.  She charges $10.00/day to owner and holds them for 7 days and then she works at adopting them out if owner doesn’t show up.  Council was in agreement County was in need of this service.

 

Angie Kreider with Rainbow Communications was present regarding new ordinance for franchise and pole rent agreement.  Discussion was held on changes coming by the end of June with no more cable as we know it being offered. 

 

Miller moved to adopt Ordinance 715 for a non-exclusive contract franchise ordinance granted to Rainbow Communications, L.L.C., a telecommunications local exchange service provider providing local exchange service within the City of Troy.  Pursuant to K.S.A. 12-2001, a non-exclusive contract franchise ordinance is hereby granted to Rainbow Communications, L.L.C., a telecommunications local exchange service provider providing local exchange service within the City of Troy.  The initial term of this ordinance shall be for a period beginning July 1, 2020 and ending August 1, 2040.  Compensation made pursuant to this contract franchise ordinance shall be paid on a semi-annual basis without invoice or remainder from the city and paid within 45 days after the last day of each 6-month period ending June 30 and December 31.  Compensation to the city pursuant to this contract franchise ordinance shall be 5% of gross receipts as defined.  Hanlan seconded the motion and it carried.

 

Hanlan moved to approved the master license agreement for attachment to city facilities at an increase from $3.00/ pole to $8.00/pole.  This is for a period of ten years.  Miller seconded the motion and it carried. 

 

Hanlan moved to approve zoning permit 2020-2 for and add on to existing shed at 119 N. 1st Street.  Ruhnke seconded the motion and it carried.

 

Clary moved to go into executive session to discuss legal matter for 10 minutes at 7:15 p.m. with Mayor, council members, city attorney, city clerk, police chief, and working superintendent present.

 

Meeting reconvened at 7:30 p.m.

 

Ruhnke moved to have another street light put up at the city shop to get rid of dark spots.  Motion died for a lack of a second.

 

City Attorney Boeh handed out statues on president of council and acting mayor positions to the council.  Clary moved to have Tim Hanlan as President of Council.  Miller seconded the motion and it carried.   In the absence of the Mayor and the President of Council the council members will vote on an Acting Mayor to run the meeting.

 

Clary moved to purchase easement for the substation from Evergy for $41,917.57.  Hanlan seconded the motion and it carried.

 

Hanlan moved to purchase land from Jerry and Jane Johnson for new sludge lagoons at water plant at a cost of $10,000.00.  Clary seconded the motion and it carried.

 

At 8 a.m. City Attorney and Police Chief left the meeting.

 

Ruhnke moved to allow $3,500.00 for the 8500 bucket truck repairs that Altec found after inspect the truck.  Clary seconded the motion and it carried.

 

 

 

 

 

 

 

 

 

 

 

 

Council reviewed water tower report. 

 

Hanlan moved to contracts with Utility Service Co., Inc. to clean 2 clear wells in town ($1,500.00) and the water plant clear well ($l,400.00).  Ruhnke seconded the motion and it carried.

 

Engemann Drainage is going to bore under Chestnut at 415 W. Chestnut to fix a leak on the city side so the street doesn’t have to be tore up.  City started flushing hydrants. 

 

Council wants someone from the Park Committee with Recreation Commission to be present at the next council meeting March 17, 2020.

 

Miller moved to reduce sewer for account 100013006 to $10.11 due to a water leak that didn’t go down the sewer.  Hanlan seconded the motion and it carried.

 

Council request a map for oil and chat by next meeting.

 

Ruhnke moved to go into executive session at 8:40 p.m. for 5 minutes to discuss non-elected personnel.  Hanlan seconded the motion and it carried.

 

Meeting reconvened at 8:45 p.m.

 

Ruhnke moved to hire Steve Adams at starting wage of $12.75 plus $.25 because he has a CDL making it $13.00 per hour with an evaluation after 6 months.  Miller seconded the motion and it carried.

 

The need for electric, water, and sewer rates to raise was mentioned.  Council agreed but want a special meeting and to discuss budget also.  No meeting date was set.

 

Clary moved to adjourn at 8:55 p.m.  Hanlan seconded the motion and it carried.
