MARCH 1 2022

 

 The Troy City Council met in regular session on March 1, 2022, at 6:30 p.m. at the Troy City Hall.  The meeting was called to order by Mayor Sarah J. Boeh-Cerra.  Mayor Sarah J. Boeh-Cerra, and Council members Tim Hanlan, Stan Ruhnke, Cody Miller, Duane Weishaar, and Micheal Brissett answered roll call.  Also present was City Clerk Jim Richardson, Chief of Police Doug Duncan, Ambulance Director Matt McKittrick, City Attorney Alan Boeh, Katie King, Jake King, Brad King, Joi Davies, Tom Jenkins, Darren Huss, Tad Blanton, Michael Silvey, Don Huss, Tom Gronniger, Brett Miner, Lacey Phillips, Corey Kostman, Denice Franken, Raymond Whittaker, Lacey Jasper, Terry Whittaker, Crystal Ashburn, Tim Franken, Bill Penny, Brian Klaus, Kelly Franken, Kevin Vanwey, Kevin McConnaughey, Jonathan Huss, Susan Williams, Richard Williams, and Derek Archey.

            Jake King address the Council concerning doing an Eagle Scout Project at the Troy Community Building consisting of building a picnic shelter.  Discussion followed.  The Council concurred to allow Jake King to proceed with the project at the Community Building.  Jake King will return to the March 15, 2022 Council meeting with additional details regarding the project. 

            Several citizens were present to address the Council concerning their disapproval of several items in ordinance number 722 regarding the operation of all-terrain vehicles, work-site utility vehicles, micro-utility trucks and golf carts within the City of Troy.  Discussion followed with the City Attorney, City Council, Chief of Police and those Citizens present.  The Council concurred that they would take the concerns of the citizens under advisement and further discussion the matter. 

            Motion was made by Stan Ruhnke, second by Duane Weishaar to approve the Council meeting minutes of February 15, 2022.  Vote unanimous.  Motion carried.

The Council reviewed and discussed the bills presented.

Motion was made by Tim Hanlan, second by Cody Miller to approve the bills as listed AP check number 13092 thru 13109 in the amount of $19,647.37.  Vote unanimous.  Motion carried.

The Council discussed the following items with Chief of Police Doug Duncan:  The potential purchase of a County drug / tracking dog.  The Council concurred to have Sherriff Chad Clary come to the March 15, 2022 to discuss the matter.

The Council discussed the following items with Ambulance Director Matt McKittrick: The Ambulance Committee RFP for county wide ambulance service. 

Motion was made by Micheal Brissett, second by Cody Miller to have the City Attorney draft a Resolution for the City of Troy in support of a Doniphan County wide ambulance service.  Vote unanimous.  Motion carried. 

The Council discussed the following items with City Clerk Jim Richardson: Getting bids for milling and asphalting Locust Street; and a bid regarding the purchase of water meters.       

Motion was made by Cody Miller, second by Tim Hanlan to accept the quote from Core & Main for a case of IPERL water meters at a cost of $1,103.60.  Vote unanimous.  Motion carried.

The Mayor, City Council, City Attorney, City Clerk, and the Chief of Police held further discussion on Ordinance number 722 regarding the operation of all-terrain vehicles, work-site utility vehicles, micro-utility trucks and golf carts within the City of Troy. 

Motion was made by Tim Hanlan, second by Micheal Brissett to remove section 4 from Ordinance number 722 that states, any person who operates an All-Terrain Vehicle, a Work-Site Utility Vehicle, a Micro-Utility Truck or a Golf Cart upon any street, alley, roadway, highway, right-of-way, public way, or public place within the City of Troy, Kansas to which is affixed a certificate issued pursuant to the terms and provisions of this ordinance is deemed to have given consent to being stopped by any law enforcement officer to determine that the vehicle being operated and the person operating such are in compliance with the terms and provisions of this ordinance.  Vote 4 yes (Brissett, Weishaar, Miller, Hanlan), 1 no (Ruhnke).  Motion carried. 

            Motion was made by Micheal Brissett, second by Cody Miller to remove section 3-B

from Ordinance number 722 that states, Every All-Terrain Vehicle, Work-Site Utility Vehicle,

Micro-Utility Truck or Golf Cart operated upon any portion of a street, alley, roadway or

highway within the City of Troy, Kansas shall be registered with the city and shall have affixed

to the rear of the vehicle in any area clearly visible to any law enforcement officer a registration

sticker issued by the City of Troy for such vehicle.  The registration sticker issued by the City of

Troy shall not be transferrable.  All registration stickers shall be valid through December 31 of

the year for which such was issued.  The fee for registering an All-Terrain Vehicle, Work-Site

Utility Vehicle, Micro-Utility Truck or Golf Cart in the City of Troy, Kansas shall be $25.00.  A registration sticker not clearly visible to and readable by a law enforcement officer shall be grounds for a law enforcement officer to stop said vehicle.  No registration sticker shall be issued for an All-Terrain Vehicle, a Work-Site Utility Vehicle, a Micro-Utility Truck or a Golf Cart until the City has been provided proof that said vehicle has liability insurance coverage thereon as provided for in Section 3 (E) of this ordinance.  Vote 3 yes (Brissett, Miller, Hanlan), 2 no (Ruhnke, Weishaar).  Motion carried. 

            Motion was made by Tim Hanlan, second by Micheal Brissett to change section 3-H to

read as follows: Except as hereinafter provided, no All-Terrain Vehicle, Work-Site Utility

Vehicle, Micro-Utility Truck or Golf Cart, even if equipped with lights as hereinafter provided,

shall be operated between 10:30 P.M. and 4:00 A.M. of the following day.  All-Terrain Vehicles, Work-Site Utility Vehicles, Micro-Utility Truck and Golf Carts which are regularly and routinely kept/stored in the City of Troy, Kansas and which are outside the city limits of the City of Troy, Kansas after 10:30 P.M., may drive said vehicle from the point where it enters the City of Troy, Kansas, to the place at which the vehicle is regularly and routinely kept/stored, utilizing the most direct route between said point of entry into the city and the place where the vehicle is regularly and routinely kept/stored.  Vote unanimous.  Motion carried

            Motion was made by Tim Hanlan, second by Micheal Brissett to change section 3-A to

read as follows:  No All-Terrain Vehicle or Work-Site Utility Vehicle powered by a two-stroke engine are allowed.  Vote unanimous.  Motion carried. 

            All changes to Ordinance number 722 will become effective when the new ordinance is passed at the March 15, 2022 Council meeting. 

There being no further business, motion was made by Stan Ruhnke, second by Tim Hanlan to adjourn the meeting. Vote unanimous.  Motion carried.  The meeting adjourned at 9:50 p.m.
