Troy City Council met on June 2, 2020, in regular session at Troy City Hall.  Mayor Sarah Boeh-Cerra called the meeting to order at 6:30 p.m.  Council members Nicholas Popple, Stan Ruhnke, Michael Brissett, and Cody Miller, City Attorney Alan Boeh, Working Superintendent Jim Horner, and City Clerk Jane Boeh were present.  Councilmember Tim Hanlan and Jeff McNemee were present for a portion of the meeting.

 

Hanlan moved to approve minutes as written for May 19, 2020.  Miller seconded the motion and it carried.

 

Ruhnke moved to approve minutes for special meeting as written for May 26, 2020.  Miller seconded the meeting and it carried.

 

Hanlan moved to approve bills Check #11753 to #11778 in the amount of $12,094.66.  Miller seconded the motion and it carried.

 

Miller moved to approve bills check #494 to 495 in the amount of $6,773.00 out of construction fund.  Brissett seconded the motion and it carried.

 

A variance hearing was held for Jeffrey A. and Caley R. McNemee owners of real estate, to  wit: C.J. Jones Add., S20, T03, R31, Block 5, Lot 1, 517 S. Park for a variance from no set back of 20’ on southside of property to put a garage in same place as old garage.  There was one letter received regarding the variance concerned about letting some one build in the street right of way.  McNemee stated to old garage was approximately 1 and ½ feet into the street right of way.  Discussion was held to vacate 1 and ½ feet of street right of one in the block but this would take a legal description and normally if this happens the resident would pay the legal fees.  McNemee agreed he could move the garage 1 and ½ feet back from the old garage and be on his property line.  Ruhnke moved to approve the 20’ variance and allow the garage to be built on property line.  Hanlan seconded the motion.  Aye Ruhnke, Hanlan, Popple and Miller.  Nay Brissett.  Motion carried.  McNemee left the meeting.

 

Ruhnke moved to approve zoning permit 2020-08 at 517 S. Park for garage being put on property line.  Hanlan seconded the motion and it carried.

 

Hanlan moved to approve zoning permit 2020-17 at 211 W State for above ground pool, deck and fence.  Brissett seconded the motion and it carried.

 

Popple moved to approve zoning permit 2020-16 at 103 S 4^th Street for a privacy fence on property line with West line being on easement line (20’ west of property line) but need the adjacent property owner’s signatures prior to being built.  Miller seconded the motion and it carried.

 

Brissett moved to recommend he build fence 5’ further (25’) east away from west property line to not be under the existing power line.  Hanlan seconded the motion and it carried.   

 

Ruhnke moved to disapprove zoning permit 2020-06 due to lack of not following up with a variance.  Hanlan seconded the motion and it carried.

 

Ruhnke moved to put a stop sign at SW corner of intersection of 3^rd and Poplar and one at the NE corner of 3^rd and Chestnut.  Hanlan seconded the motion and it carried.

 

Brissett moved to take the bid of Littleman Construction LLC for the replacement of Well house #1 7 x 9 building damage when truck hit it.  Hanlan seconded the motion and it carried.  Council instructed City Clerk to turn in insurance claim on this matter and construction has to wait until claim is settled.

 

Miller moved to go into executive session to discuss non-elected personnel at 7:30 p.m. for 10 minutes with all present remaining.  Ruhnke seconded the motion and it carried.

 

Meeting reconvened at 7:35 p.m.  No action was taken.

 

Backflow prevention devices for businesses was discussed.  Brissett moved to send a letter to those who have not yet installed back flow devices a final warning due to Covid-19 they have until July 7, 2020 at noon to get proof to the city they have the needed devices installed or their water will be shut off.  Hanlan seconded the motion and it carried.

 

 

 

 

 

 

 

 

 

 

Ruhnke moved to go into executive session at 7:45 p.m. to 15 minutes to discuss non-elected personnel with City Clerk and City Attorney leaving the meeting.  Hanlan seconded the motion and it carried.

 

Meeting reconvened at 8 p.m. with City Clerk and City Attorney coming back to meeting.

 

Brissett moved to go into executive session at 8 p.m. for 15 minutes to discuss non-elected personnel with all present remaining.  Hanlan seconded the motion and it carried.

 

Meeting reconvened at 8:15 p.m. Working Superintendent Horner was called out for a power outage.

 

Council moved to table the approval of the municipal water conservation plan until next meeting.

 

Council was read email from Evergy regarding metering on transformer loss compensation piece of this since Evergy are leaving the metering on the low side until a metering upgrade is warranted.  Due to the age of the transformers, we are unable to determine the transformer loss percentage on these specific units.  This is important because when Evergy owned the substation they applied a loss factor to the meter data in order to determine what the City’s true usage/demand was.  With the City owning the substation once we get the record of easement and the metering remaining on the low side of the meter, they need to factor that in by way of transformer low compensation.  Since they do not have the calculations we need, the City is agreeable to utilize the FERC approved loss percentages they would have used if Evergy sill owned the substation.  They will use the difference between loss factors D and E below the demand (0.0059) and K and L for energy (0.0063).  A table was provided showing the FERC approved loss factors they currently use.

When or if the City upgrades the transformers, Evergy could then use the manufacturer’s data to adjust the meter data accordingly for the new transformers.  If the City upgrades, we need to tell Evergy so they can adjust their setting

 

Once a metering upgrade is necessary, Evergy will no longer need to worry about any transformer loss compensation since the metering will be on the high side.

 

Electric project is trying to get a kickoff set up for this week.

 

The preliminary engineering report for the planning grant for water treatment plant was received May 20,2020 by the Bureau of Water.  They needed the waste stream summary review so the Amendment #2 with BG approved 5ht of May was sent to BG Engineers to get the PER done so the Plans can move forward hopefully for approval.
