The Troy City Council met in regular session on July 19, 2022, at 6:30 p.m. at the Troy City Hall. The meeting was called to order by Mayor Sarah J. Boeh-Cerra. Mayor Sarah J. Boeh-Cerra and Council members Micheal Brissett, Stan Ruhnke, and Duane Weishaar answered roll call. Council members Cody Miller and Tim Hanlan were absent. Also present were City Clerk Jim Richardson, Working Supervisor Jim Horner, City Attorney Alan Boeh, Ambulance Director Matt McKittrick, Police Officer Mark Allen, Shelly Smith, and Trina Earl.
Motion was made by Stan Ruhnke, second by Micheal Brissett to approve the Council meeting minutes of July 5, 2022. Vote unanimous with those Council members present. Motion carried.
The Council reviewed and discussed the bills presented.
Motion was made by Micheal Brissett, second by Duane Weishaar to approve the bills as listed AP check number 13369 thru 13405 in the amount of $91,829.49. Vote unanimous with those Council members present. Motion carried.
The Council discussed the following items with Working Supervisor Jim Horner: The heater in well #2; the upcoming oil and chat for 2022; and Jim Horner requested that he be allowed to have a fish fry at the City Pond.
The Council concurred to allow Jim Horner the use of the City Pond for a fish fry.
Shelly Smith from Last Chance Saloon requested the use of Main Street between Walnut and Chestnut on August 20, 2022 from 5:00 p.m. to 12:00 a.m. for a street dance and beer garden. Discussion followed.
Motion was made by Micheal Brissett, second by Duane Weishaar, to close Main Street between Walnut and Chestnut on August 20, 2022 from 5:00 p.m. to 12:00 a.m. for a street dance and beer garden, with the application for the CMB special permit for the beer garden being filed by Harry Smith the owner of the Last Chance Saloon to be approved at the August 2, 2022 council meeting. Vote unanimous with those Council members present. Motion carried.
The Council discussed the following items with Police Officer Mark Allen: The LMI surveyor going from door to door in the City;various nuisance violations within the city; and vagrants living at the City Park and the 4H grounds.
Mayor Sarah J. Boeh-Cerra brought up a request from the School to close Poplar Street in front of the grade school on August 29, 2022 from 3:00 p.m. to 9:00 p.m. for an open house and block party. Discussion followed.
Motion was made by Duane Weishaar, second by Stan Ruhuke to allow the School to close Poplar Street in front of the grade school on August 29, 2022 from 3:00 p.m. to 9:00 p.m. for an open house and block party.
City Clerk Jim Richardson presented the Council with Building Permit number 2022-12 for Jesse Smith at 405 W. Robertson St. for a 10’ X 20’ deck addition attached to the back of the house. Discussion followed.

Trina Earl from Doniphan County Pet Rescue addressed the Council Concerning the City purchasing a proper kennel for dogs picked up for running at large. Discussion followed.
Motion was made by Micheal Brissett, second by Stan Ruhnke to purchase a dog kennel for city use not to exceed $700.00. Vote unanimous with those Council members present. Motion Carried.
City Clerk Jim Richardson brought up the matter of filing the Notice of Revenue Neutral
Rate Intent with the County Clerk. City Clerk Jim Richardson informed the Council this had to be filed because of the Cities intent to exceed the revenue neutral rate of 43.645 mills on the 2023 budget. Discussion followed.
Motion was made by Duane Weishaar, second by Micheal Brissett to file the Notice of Revenue Neutral Rate Intent with the County Clerk. Vote unanimous with those Council members present. Motion Carried.
Mayor Sarah J. Boeh-Cerra requested a 5 minute executive session for non-elected personnel.
Motion was made by Duane Weishaar, second by Micheal Brissett to go into executive session for 5 minutes for non-elected personnel with Mayor, City Council, City Attorney and the City Clerk. Vote unanimous with those Council members present. Motion carried. Executive session started at 8:20 p.m. The meeting reconvened at 8:25 p.m. with no action taken.
Mayor Sarah J. Boeh-Cerra requested a 5 minute executive session for legal matters.
Motion was made by Duane Weishaar, second by Micheal Brissett to go into executive session for 5 minutes for legal matters with Mayor, City Council, City Attorney and the City Clerk. Vote unanimous with those Council members present. Motion carried. Executive session started at 8:26 p.m. The meeting reconvened at 8:31 p.m. with no action taken.
The Council discussed potential annexation.
