The Troy City Council met in regular session Tuesday December 7, 2021, at 6:30 p.m. at the Troy City Hall. The meeting was called to order by Mayor Sarah J. Boeh-Cerra. Mayor Sarah J. Boeh-Cerra and Council members Stan Ruhnke, Cody Miller, Tim Hanlan, Micheal Brissett answered roll call. Also present were City Clerk Jim Richardson, City Attorney Alan Boeh, Working Supervisor Jim Horner, Chief of Police Doug Duncan, Walter Clary, Paul Moore, and Harry Smith.
Motion was made by Micheal Brissett, second by Tim Hanlan to approve the Council minutes of November 16, 2021. Vote – unanimous. Motion carried.
The Council reviewed and discussed the bills presented.
Motion was made by Micheal Brissett, second by Tim Hanlan to approve the bills as listed Utility Deposit Refund check number 12898 and AP check number 12899 thru 12947 in the amount of $142,503.17. Vote – unanimous. Motion carried.
Mayor Sarah J. Boeh open the public hearing for Grant number 19-PF-009 closeout. Grant administrator Garrett Nordstrom from Governmental Assistant Services presented the Council with the required paperwork necessary to closeout Grant number 19-PF-009. No citizens were present for comment.
Motion was made by Tim Hanlan, second by Cody Miller to close the public hearing for Grant number 19-PF-009. Vote – unanimous. Motion carried.
Motion was made by Tim Hanlan, second by Micheal Brissett to authorize the Mayor and City Clerk to sign the necessary paperwork to close out Grant number 19-PF-009. Vote – unanimous. Motion carried.
Mayor Sarah J. Boeh open the public hearing for the 2021 proposed budget amendments. Discussion followed. There were no citizens present for comment on the budget.
Motion was made by Tim Hanlan, second by Cody Miller to close the public hearing on the 2021 budget amendments. Vote – unanimous. Motion carried.
Motion was made by Tim Hanlan, second by Cody Miller to adopt the 2021 budget amendments. Vote – unanimous. Motion carried.
Mayor Sarah J. Boeh-Cerra opened the extended hearings for properties served notice for existing nuisances. Walter Clary, and Paul Moore for himself and Gary and Mary Simpson were present to addressed the Council concerning their properties. Discussion followed with the Council.
Motion was made by Tim Hanlan, second by Cody Miller to extend the hearing for Walter Clary at 103 N. 2nd Street until June 7, 2022 to bring his property into compliance. Vote – unanimous. Motion carried.
Motion was made by Tim Hanlan, second by Cody Miller to extend the hearing for Paul Moore at 109 N. 6th Street until June 7, 2022 to bring his property into compliance. Vote – unanimous. Motion carried.
Motion was made by Tim Hanlan, second by Cody Miller to extend the hearing for Gary & Mary Simpson at 00000 S. 6th Street until June 7, 2022 to bring their property into compliance. Vote – unanimous. Motion carried.
The Council discussed the properties owned by Colin and Nora Kitzman at 123 N. Liberty and the property at 105 S. Boder owned by the Community Recreation Association Inc.
Harry Smith addressed the Council concerning bringing a trailer into the City of Wathena that is over the age limit of fifteen years. Discussion followed.
The Council discussed the following items with Working Supervisor Jim Horner: Repair issues regarding the electrical substation; and disposing of old City Christmas decorations.
City Clerk Jim Richardson presented the City Council with the survey form Midland Surveying regarding the potential vacating of the alley between the properties at 433 S. Park and
439 S. Park. Discussion followed.
City Attorney Alan Boeh brought up the matter of the proposed ordinance regarding the operation of all-terrain vehicles, work-site utility vehicles, micro-utility trucks and golf carts within the City of Troy, Kansas. Discussion followed.
Council member Micheal Brissett updated the Council on the Ambulance Committee. Discussion followed.
City Attorney Alan Boeh requested a 10 - minute executive session for legal matters deemed privileged in the attorney – client relationship.
Motion was made by Stan Ruhnke, second by Tim Hanlan to go into executive session for 10 minutes for legal matters deemed privileged in the attorney – client relationship with Mayor, City Council, City Clerk, City Attorney and the Chief of Police. Vote – unanimous. Motion carried. Executive session started at 7:42 p.m. The meeting reconvened at 7:52 p.m. with no action taken.
Motion was made by Cody Miller, second by Micheal Brissett to go into executive session for 5 minutes for legal matters deemed privileged in the attorney – client relationship with Mayor, City Council, City Clerk, City Attorney and the Chief of Police. Vote – 3 Yes, 1 No (Ruhnke). Motion carried. Executive session started at 7:52 p.m. The meeting reconvened at 7:57 p.m. with no action taken.
Motion was made by Micheal Brissett, second by Tim Hanlan to authorize City Attorney Alan Boeh to send a letter in response to the letter received by the City of Troy in regards to Lower State Street. Vote – unanimous. Motion carried.
Mayor Sarah J. Boeh-Cerra brought up the matter of buying coat & boot equipment for the Ambulance Department. Discussion followed.
Motion was made by Micheal Brissett, second by Cody Miller to authorize the purchase of coat & boot equipment for the Ambulance Department at a cost not to exceed $1,500.00. Vote – unanimous. Motion carried.
Mayor Sarah J. Boeh-Cerra brought up the matter of Christmas bonuses for City employees. Discussion followed.
Motion was made by Stan Ruhnke, second by Micheal Brisset to give present fulltime employees $275.00 and part-time employees, City Treasurer, and the Court Judge $150.00 as Christmas bonuses. Vote – unanimous. Motion carried.
Motion was made by Stan Ruhnke, second by Tim Hanlan to give present fulltime employees $75.00 gift certificates to John’s Market and $50.00 gift certificates to John Market for all present part-time employees and on call active ambulance volunteers. Vote – unanimous. Motion carried.
Mayor Sarah J. Boeh-Cerra requested a 5 - minute executive session for non-elected personnel.
Motion was made by Stan Ruhnke, second by Cody Miller to go into executive session for 5 minutes for non-elected personnel with Mayor, City Council, and City Clerk. Vote – unanimous. Motion carried. Executive session started at 8:35 p.m. The meeting reconvened at 8:40 p.m. with no action taken.
There being no further business, motion was made by Stan Ruhnke, second by Micheal Brissett to adjourn the meeting. Vote – unanimous. Motion carried. The meeting adjourned at 8:41 p.m.
