Ord 677 Water Rates

                                                                          CITY OF TROY,KANSAS

                                                                             ORDINANCE NO. 677

AN ORDINANCE OF THE CITY OF TROY, KANSAS, ESTABLISHING RATES FOR USERS OF WATER, PROVIDING FOR TAPS AND CONNECTIONS TO THE CITY’S WATER MAINS AND ESTABLISHING THE RATES THEREFORE, PROVIDING FOR THE INSTALLATION OF WATER METERS AND FOR SECURITY DEPOSIT, PROVIDING FOR APPLICATION OF THE WATER SECURITY DEPOSIT TO THE SATISFACTION OF UNPAID CHARGES OR BILLS, PROHIBITING THE MAKING OF INSTALLATIONS, TAPS AND CONNECTION BY CERTAIN PERSONS, PROVIDING PENALTIES FOR VIOLATING CERTAIN PROVISIONS OF THIS ORDINANCE, FIXING DATES FOR THE PAYMENT OF WATER BILLS, PROVIDING FOR THE BILLING AND PAYMENT OF CHARGES, PROVIDING FOR THE IMPOSITION OF A DELINQUENCY CHARGE AND FOR THE DISCONTINUANCE OF WATER SERVICE FOR FAILURE TO PAY BILL, PROVIDING FOR A FIVE PERCENT (5%) INCREASE, EFFECTIVE JULY 1, 2014, OF THE RATES SPECIFIED IN SUBSECTIONS (A), (B), (C), (D), (F), AND (G) OF SECTION ONE OF THIS ORDINANCE.  REPEALING ORDINANCE NO. 657 AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH.

                        BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OFTROY,KANSAS:

                        SECTION ONE: That the rates to be charged by the City of Troy, Kansas, to users of water supplied by the City of Troy, Kansas, shall be as follows:

                        (A) Each user of water having a water meter serving property situated entirely or partially within the limits of the City of Troy, Kansas, shall be assessed a monthly base charge of Fifteen Dollars ($15.00) per water meter.  This base charge shall not entitle the user to or constitute payment for any water.

                        (B) Each user of water having a water meter serving property situated entirely or partially within the limits of the City of Troy, Kansas, shall, in addition to the base charge provided for in sub-section (a) of this section pay for all water used at the rate of $0.00484 per gallon.

                        (C) Each user of water having a water meter serving property situated entirely outside the limits of the City of Troy, Kansas, shall be assessed a monthly base charge of Twenty-Two Dollars ($22.00) per water meter.  This base charge shall not entitle the user to or constitute payment for any water.

                        (D) Each user of water having a water meter serving property situated

entirely outside the limits of the City of Troy, Kansas, shall, in addition to the base charge provided for in sub-section (c) of this section pay for all water used at the rate of $0.00590 per gallon.

                        (E) Each user of water obtaining water directly from the City’s mains without the installation of the usual meter shall pay for such water at the rate of Twenty-Five Cents ($.25) for each fifty (50) gallons or fraction thereof.

                        (F) All other users not included in sub-sections (A), (B), (C), (D) and (E) above obtaining water from the City of Troy, Kansas, shall pay for the same at the rate of $0.00563 per gallon.  This rate shall be applicable to Rural Water District No. 5 ofDoniphan County,Kansas, should it, pursuant to the contract between it and the City, again elect to obtain water from the City.

                        (G) In situations where a water meter has been installed for a user of water and users in addition to the one for whom the meter has been installed are receiving water therefrom, an additional charge of Five Dollars and Eighty Cents ($5.80) per month for each additional user shall be made with such charge to be billed to and paid by the water meter user.  For the purposes of this sub-section, “additional user” shall be defined as any business, household, trailer house, mobile home or other separate water user supplied water by the City of Troy for whom/which no separate water meter has been installed, it being the intention of this sub-section to impose an additional charge for water in circumstances where several separate uses of water are being made, but where only one water meter has been installed, examples of such uses being but not limited to, mobile home and trailer parks, two-business establishments receiving water from one meter, or a home and a separate business receiving water from one meter.

                        SECTION TWO: Effective July 1, 2014 the rates specified in subsections (A), (B), (C), (D), (F) AND (G) of SECTION ONE of this ordinance shall be increased by five percent (5%). 

                        SECTION THREE:  Any user or prospective user of water requesting the City of Troy, Kansas, to make any connection with the water mains of the City of Troy shall, in addition to the deposit required in Section Five of this Ordinance, be required first to pay to the City of Troy the sum of Seven Hundred Eighty-Seven Dollars and Fifty Cents ($787.50) for each three-fourths (3/4) inch tap to be made.  For any larger tap an appropriate and proportionately greater additional charge shall be made to cover the costs to the City of the installation of the tap and meter.  All taps and connections to the water system of the City ofTroyshall be made by the City and its duly authorized employees and agents, and it shall be unlawful for any other person or persons to make such taps or connections.  All taps to the water system of the City shall be made at the water main nearest to the property of the user or prospective user.  The City shall lay pipe from the main only to the edge of the street or alley nearest to the property of the user or prospective user, and in no event will provide more than fifty (50) feet of pipe.  Any additional pipe used to effect a connection shall be at the expense of the user or prospective user, and an additional charge to cover the costs of the same shall be made by the City.

                        SECTION FOUR: The City of Troy, Kansas, shall install a meter box and a meter in the same at, or as near to as is reasonably possible, the property line of the premises to be served.  The City shall also make all connections between its water main and said meter.  It shall be unlawful for any person or persons, other than duly authorized employees or agents of the City, to make any taps or connections to the City water system or to tamper with water mains, meters or equipment in any manner.

                         SECTION FIVE: Any person violating any of the provisions of Section Two and/or Three of this Ordinance shall be deemed guilty of a misdemeanor and shall, upon conviction therefore, be fined not less than Twenty-Five Dollars ($25.00) and not more than Five Hundred Dollars ($500.00) for each violation, and shall be subject to disconnection of water services.

                         SECTION SIX: The water meters above referenced shall be owned by the City of Troy, Kansas, and any person making a request for connection to the water mains of the City of Troy or for water service shall deposit with the City the sum of Twenty-Five Dollars ($25.00), as a guarantee that water used will be paid for, and said deposit may be used for the payment of charges or bills for water used when the bills therefore remain unpaid on the 20th day of the month in which they are due.  No water meter shall be installed or water service provided until the payment of the deposit herein provided for.

                         SECTION SEVEN: Bills for water service shall be rendered monthly and shall be calculated at the rates provided for in this Ordinance.  Bills shall be dated the first day of each month and if not paid within ten (10) days, an additional service charge of ten percent (10%) of the gross amount of the total water bill will be assessed against the customer.  If a water bill is not paid within twenty (20) days after the date of such bill, service may be discontinued.  Where services have been so discontinued, an additional service charge of One Hundred Dollars ($100.00) shall be paid by the user for re-connection of services.

                         SECTION EIGHT: Ordinance No. 657 of the City of Troy, Kansas, and all ordinances and parts of ordinances of the City of Troy, Kansas, in conflict herewith are hereby repealed.

                         SECTION NINE: This Ordinance shall be in full force and effect from and after its publication in The Kansas Chief, the official paper for the City of Troy, Kansas.

                        Passed by the Council and approved by the Mayor of the City of Troy, Kansas, on the 18TH day of June, 2013.
