Ordinance No. 77
An Ordinance Relating to Animals Running at Large or Being Picketed in the Streets
Be it ordained by the Mayor and Councilmen of the City of Troy:
Section 1.
It shall be unlawful for any person owning or having the care or control of any horse, cattle, hog, or sheep to permit the same to run at large or be picketed upon any street, alley, or public place within the limits of the City of Troy, nor upon any uninclosed lot therein so as to encroach upon or obstruct any street or alley.
Section 2.
It shall be the duty of the City Marshal to take up and impound any such animals found running at large or picketed, as mentioned in Section 1, within the limits of the city.
On the same day the animals are impounded, the Marshal shall advertise them by posting at least three notices within the business part of the city, describing the animals and notifying all interested persons that, unless the animals are proved and redeemed by payment of the expenses of feeding and the Marshal’s fees within ten days, the animals will be sold by the Marshal as provided in this ordinance.
Section 3.
At the expiration of the ten-day notice period, the Marshal shall sell any unredeemed animals at the city pound, at public auction, to the highest bidder for cash.
After deducting:
- the Marshal’s fees; and
- fifty cents ($0.50) per day for feeding and keeping each animal,
the Marshal shall pay the remaining balance, if any, to the City Treasurer.
Section 4.
The Marshal shall receive for taking up and impounding each animal the sum of one dollar ($1.00), to be paid by the person redeeming the animal.
If the animal is sold, the Marshal shall receive an additional one dollar ($1.00) for each animal sold, all to be paid from the proceeds of the sale.
Section 5.
This ordinance shall take effect and be in force from and after its publication in The Weekly Kansas Chief.
