ORDINANCE NO. 255
AN ORDINANCE AUTHORIZING AND DIRECTING THE ISSUANCE OF WATER WORKS BONDS BY THE CITY OF TROY, KANSAS, IN THE SUM OF $95,000.00 DOLLARS FOR THE PURPOSE OF PROVIDING FUNDS FOR CONSTRUCTING A WATER WORKS SYSTEM TO SUPPLY SAID CITY AND ITS INHABITANTS WITH WATER.
WHEREAS, an ordinance was duly passed by the governing body of the City of Troy, Kansas, whereby a special election was ordered to be held in said city on January 11th, 1929. For the purpose of submitting to the qualified electors of said the city the question of issuing the bonds for constructing a water works system to supply said city and its inhabitants with water; and
WHEREAS, pursuant to said ordinance, notices of said election was duly prepared and issued by the Mayor and the City Clerk, and was duly published in the manner prescribed by law; and
WHEREAS, the said special election was duly held according to the provisions of said ordinance and notices and the statutes of the State of Kansas; and
WHEREAS, the votes cast at said special election were duly canvassed as provided by law, and it appeared that a majority of all of the legal voters of said city voting at said election voted in favor of the issuance of said bonds, and that the proposition to authorize the issuance of said bonds was carried by a vote of 244 votes for said proposition and 166 votes against said proposition.
NOW THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF TROY, KANSAS, AS FOLLOWS:
SECTION (1). That for the purpose of providing funds for constructing a water works system to supply the City of Troy, Kansas and its inhabitants with water, there shall be issued, and hereby are issued, water works bonds of the City of Troy, Kansas, in the total principal amount of $95,000.00.
SECTION (2). Said issue shall consist of 100 bonds numbered from 1 to 100 inclusive, 80 of said bonds being in the sum of $1,000.00 each and 20 of said bonds being in the sum of $750.00 each. All of said bonds shall be dated July 15th, 1929 and shall become due serially as follows: $1,000.00 on July 15th, 1930; $1,000.00 on July 15th, 1930; $1,000.00 on July 15th, 1930; $1,000.00 on July 15th, 1930; and $750.00 on July 15th, 1930, and four (4), $1,000.00 bonds and one (1), $750.00 bond due on July 15th of each year thereafter for nineteen (19) years. Said bonds shall bear interest at the rate of four and one-half (4½) per cent per annum, payable semi-annually on July 15th and January 15th. Both principal and interest of said bonds shall be payable at the office of the State Treasurer of the State of Kansas in the City of Topeka, Kansas.
SECTION (3). Said bonds shall be signed by the Mayor and attested by the City Clerk of said City and the corporate seal of the City shall be affixed to said bonds, and the interest coupons which shall be attached to said bonds shall be executed with the facsimile signature of said Mayor and City Clerk.
SECTION (4). Said bonds shall be executed in the form and shall contain recitals substantially as follows:

KNOW ALL MEN BY THESE PRESENTS, That the City of Troy, in the County of Doniphan, State of Kansas, for value received, hereby acknowledges itself to be indebted and promises to pay to the bearer the sum of
$1,000.00 Dollars
in lawful money of the United States of America, on the 15th day of July, 1930, with interest thereon from the date thereof at the rate of four and one-half (4½) per cent per annum, payable semi-annually on the 15th day of July and January in each year after the date hereof, until said principal and sum shall have been paid, the first interest coupon however becoming due on January 15th, 1930, upon presentation and surrender of the interest coupons
hereto attached, bearing the facsimile signatures of the Mayor and City Clerk of said City, as said coupons severally become due, both principal and interest of this bond being payable at the office of the State Treasurer of the State of Kansas, in the City of Topeka, Kansas, in lawful money of the United States, and the full faith, credit and resources of said city are hereby irrevocably pledged for the prompt payment of said principal and interest at maturity.
This bond is one of a series of 100 bonds of like date and tenor excepting denomination and maturity aggregating the principal sum of $95,000.00 issued by the City of Troy, Kansas, for the purpose of providing funds for constructing a water works system to supply said city and its inhabitants with water, the authority of and in full compliance with the provisions, restrictions, and limitations of the Constitution and laws of the State of Kansas, including Sections 12-801 to 12-805 inclusive, 12-834, 10-101 to 10-125 inclusive and 10-303 of the Revised Statutes of Kansas for 1923, and all amendments thereof; and all other provisions of the law of the said state; and this bond and all other bonds of said series and all of the interest thereon are to be paid by said City of Troy, Kansas.
And it is hereby declared and certified that all acts, conditions, and things required to be done or to exist precedent to and in the issuance of this bond have been properly done and performed and do exist in due and regular form and manner as required by the Constitution and laws of the State of Kansas, and that the total indebtedness of said City, including this series of bonds, does not exceed any constitutional or statutory limitation.
IN WITNESS WHEREOF, the said City of Troy, in the State of Kansas, by its Mayor and Councilmen, has caused this bond to be signed by its Mayor and its corporate seal to be hereto affixed, attested by its City Clerk, and the coupons hereto attached to be signed with the facsimile signatures of said officers, and this bond to be dated this 15th day of July, 1929.
