An ordinance relating to the spraying of shade trees, fruit trees, and shrubbery within the City of Troy, Kansas, and providing penalties for the violation of this ordinance.
Whereas it is a well known fact that the shade trees, fruit trees, and shrubbery within the City of Troy, Kansas are among our most valuable assets, and
Whereas it has been found that certain of our shade trees, fruit trees, and shrubbery are infested with dangerous insect pests and plant diseases which are dangerous to their existence, and
Whereas in order to protect and safe guard our fruit trees, shade trees and shrubbery, it is necessary that some action be taken towards the extermination of said insect pests and plant diseases; and
Whereas, the State of Kansas through the means of its Entomological Commission, has provided an agency for the detection and methods of control of said insect pests and plant diseases which are dangerous to our shade trees, fruit trees, and shrubbery,
Now therefore be it ordained by the Governing Body of the City of Troy, Kansas:
Section (1) That the interests of the residents of the City of Troy, State of Kansas, make it imperative that care be taken to discover and to control those insect pests and plant diseases which are dangerous to our shade trees, fruit trees and shrubbery, and to this end that the said shade trees, fruit trees and shrubbery shall be sprayed, it is hereby provided that the City of Troy, and with the aid and advice of the Entomological Commission of the State of Kansas, shall be authorized to regularly distribute, provide or spray any and all shade trees the City of Troy in a careful and workmanlike manner in order to control all insect pests and plant diseases, which are now or may become dangerous to the shade trees, fruit trees and shrubbery within the City of Troy, and that said removal or spraying shall be done in such manner and at such times as shall be found by the said City, or by said Entomological Commission of the State of Kansas to be the easiest and proper time or method for the control and eradication of such danger to our shade trees, fruit trees and shrubbery.
Section (2) That any and all costs necessary and needful for the control of insect pests and plant diseases dangerous to the shade trees, fruit trees and shrubbery within the City of Troy, either by removal, pruning or spraying, etc., and they are hereby authorized.
Section (3) That any person or persons owning or having control or custody of any shade trees, fruit trees, or shrubbery within the City of Troy, which are infested with any dangerous insect pests or plant diseases, which is dangerous or may become dangerous to the shade trees, fruit trees and shrubbery within the said City, and who shall fail to remove, prune or spray or to allow the same to be removed, pruned, or sprayed as above provided, shall be deemed guilty of a misdemeanor, and upon conviction be punished by a fine not less than $5.00 or more than $100.00.
Section (4) That all ordinances and parts of ordinances inconsistent with the provisions hereof, shall be and the same are hereby repealed, and in event any part or section of this ordinance shall be held to be ultra vires, illegal or invalid, it shall not be construed to affect any other part of this ordinance which may remain
Section (5) This ordinance shall take effect and be in force ten days from and after its first passage, approval and publication in the Kansas Chief, a paper of general circulation within the City of Troy, Kansas.
