An Ordinance Relating to Penal Offenses
ARTICLE I
Penal Offenses Against Good Order and Decency
Sec. 2. Disorderly Houses and Exposure.
Sec. 4. Intoxication and Obscene Language.

Sec. 6. Horse Racing and Gaming on Sunday.
Sec. 7. Gift Enterprises and Three-Card Monte.

Be it ordained by the Mayor and Councilmen of the City of Troy:
Section 1. That the several acts and offenses specified in this ordinance are hereby prohibited in the city, and any person found guilty, upon conviction of any or either of them, shall be subject to the penalties herein provided, respectively.
Sec. 2. Any person or persons who shall, in this city, engage in the keeping of a house of ill fame, bawdy house, or house of any kind for the purpose of prostitution, or a house wherein disorderly, licentious, obscene, lewd or indecent conduct is permitted or allowed, or shall entice or take into any such house for the purpose of seduction or prostitution any female, shall be fined in a sum of not less than twenty-five dollars nor more than one hundred dollars.
Sec. 3. Any person or persons who shall appear in any public place in this city in a state of nudity, or in a dress not belonging to his or her sex, or in any indecent or lewd dress, or shall make any indecent exposure of his or her person, or be guilty of any indecent act or behavior, or shall exhibit, sell or offer for sale any indecent or lewd picture, book, or other thing, or shall exhibit or perform any indecent, immoral or lewd play or other representation, shall be fined in a sum not exceeding one hundred dollars for each offense.
Sec. 4. Any person being found intoxicated, or using any profane or obscene language, in any street, alley, or public place in this city, or in any private or other place to the annoyance of any citizen or person, shall, upon conviction, be fined not less than two nor more than ten dollars.
Sec. 5. Any person who shall be found drunk in the streets so as not to be able to take care of himself, or endangering the safety of others, shall be taken charge of by the City Marshal and put in the watch house and kept until sober, when he shall be brought before the Police Judge and fined in a sum not exceeding ten dollars.
Sec. 6. Every person who shall be guilty of horse racing, cock fighting, or playing at cards or games of any kind on the first day of the week, commonly called Sunday, shall be fined not less than five nor more than fifty dollars.
Sec. 7. Any person who shall, in this city, start or operate or carry on any gift enterprise, or play at a game commonly called three-card monte, or any game with cards or other device for the purpose of swindling any person or persons, shall be fined in a sum of not less than ten dollars nor more than one hundred dollars for each offense.
Sec. 8. Any person or persons who shall, in this city, set up or keep any gambling house, table or device, at which any game of chance shall be played for money or property, shall be fined in a sum not exceeding one hundred dollars for each offense.
Sec. 9. It shall be unlawful for any person to carry on, either as proprietor or agent, or otherwise, within the City of Troy, any gift or prize scheme or lottery enterprise, under whatever name the same may be known, or to sell any ticket or chances in any such scheme or enterprise, and any person who shall violate any provision of this section shall be fined in any sum not less than ten nor more than fifty dollars.
Sec. 10. Any person who shall keep, maintain or harbor in this city any female prostitute, knowing her to be such, shall be fined in a sum not less than five nor more than fifty dollars.
Sec. 11. Any person who shall keep and maintain, in this city, a house, hall or other place, and shall keep, permit or allow persons of reputed bad, lewd or licentious character to congregate therein for the purpose of whoring, carousing, tippling, revelling, or engaging in any obscene, disreputable or indecent conduct shall be fine not less than ten nor more than one hundred dollars.
Sec. 12. Any person who shall commit any act specified in the preceding section shall be fined not less than ten nor more than one hundred dollars.
Sec. 13. Each and every person who shall attend or frequent such a place as in the last preceding section mentioned, and engage or take part in any of the acts or conduct therein specified, shall be fined not less than five nor more than fifty dollars for each and every offense.
Any person or persons who shall knowingly hire, let, lease or rent any house, hall, tenement or other place in this city to any person or persons who intend to use the same for the purpose of keeping or maintaining therein a house of ill fame, bawdy house, or house of any kind for the purpose of prostitution, shall, upon conviction, be fined in a sum not less than ten nor more than one hundred dollars.
Sec. 14. Any person or persons who shall be found, within the city limits of Troy, loitering around or about dram shops, saloons, restaurants, or railroad depots, or wandering about the streets, by day or night, without any visible means of livelihood or support, and not being able to give a satisfactory account of themselves, or shall be found trespassing in the night upon the premises of any citizen of this city, or being on any street or alley to beg for alms, or disturb any place where public or private schools are held, shall, upon conviction, be fined in a sum not less than one dollar nor more than one hundred dollars.
Sec. 15. Any person who shall hitch any jackass or stallion, not in harness, or exhibit any such animal in the streets of this city, shall be subject to a fine of not less than five nor more than twenty dollars.

Sec. 16. That Any tree or more persons in this city shall assemble together with the intent, or being assembled shall mutually agree to commit an unlawful act, with force and violence, against the property of the citizens of Troy, or the person or property of any other person or persons, against the peace or to the terror of any of the inhabitants of said city, or shall make any movement or preparation therefor, shall on conviction be fined a sum not less than one dollar nor more than one hundred dollars.
Sec. 17. All persons at such meeting or assembly, and knowing the intention of such persons to commit an offense, who shall fair to try to prevent or assist in the prevention of such offense, shall be deemed parties to the commission of such offense, and shall be fined as in the proceeding section provided.
Sec. 18. Whoever shall in this city, willfully disturb the peace and quiet of others, by any violent, tumultuous offensive or outrageous conduct, or by loud or unusual noise, or shall use towards any other person any indecent, profane, or offensive language, calculated to provoke a breach of the peace, shall upon conviction, be fined, not less than one dollar nor more than one hundred dollars.
Sec. 19. Any person or persons who shall, in this city, disturb or disquiet any congregation met for religious worship or any religious or moral lecture, or any exhibition of a moral or religious nature, or any public or private school, by making a noise or by rude or indecent behavior, or profane discourse, with the place of worship or assembling, or so near the same as to disturb the solemnity and qui8et of the same, shall upon conviction, be fined in a sum not exceeding hundred dollars.
Sec. 20. Any person who shall in this city, intentionally ride or drive any horse, mule, or other beast in a violent or furious manner, or who shall so ride or drive as to be likely to en danger the safety of others, or who shall so ride or drive as to run away, or any person who shall leave any of the animals above mentioned or any team on any of the public streets or public square of this city, without being securely hitched or fastened; or any person who shall drive any such animal or vehicle as to come into collision with any other animal or vehicle or strike any other animal or person, or to cause any other animals or team to run away or escape shall upon conviction, be fined a sumo not more than one hundred dollars for each offense.
Sec. 21. Any person, in this city, who is the owner of any cow, ox, horse, or other animal which shall become noted as breachy or mischievous, and who shall permit the same to run at large, knowing the same to be breachy or mischievous, shall, upon conviction, be fined in a sum of not less than one dollar nor more than ten dollars for each offense.
Sec. 22. Any person who, in this city, shall discharge any gun or firearm into any street or public place, or in the direction of any house or public street or place in this city, shall be fined in a sum not exceeding twenty dollars for each offense.
Sec. 23. Any person or persons who shall willfully introduce, by any mode, manner or way, any contagious disease into the city, or among the inhabitants thereof, or who shall come from any place where any contagious disease is prevailing in an epidemic form into the City of Troy during the prevalence of such disease, shall, upon conviction, be fined in any sum not exceeding one hundred dollars, and shall forthwith be taken by the City Marshal five miles beyond the city limits.
Sec. 24. Any person who shall fire off any cannon, gun, pistol or firearm of any description, or fire, explode or set off any Chinese or other fireworks, or any squib, firecracker or other combustible material, in the public streets of the city without the consent of the Council, or written consent of the Mayor, shall, upon conviction, be fined in a sum of not less than one dollar nor more than one hundred dollars for each offense.
Sec. 25. Any person who shall, in this city, draw any pistol, revolver or other weapon in a hostile manner, or shall make any demonstration or threat of using such weapon on or against any person, or any person who shall carry or have on his or her person, in a concealed manner, any pistol, revolver, dirk, bowie knife, slung shot, billy, brass, lead or iron knuckles, or other deadly weapon, within this city, shall be fined in a sum of not less than five nor more than one hundred dollars; provided, that this ordinance does not prohibit officers of the law, while on duty, from being armed.
Sec. 26. It shall be unlawful for any person or persons to ride on hand sleds on any of the sidewalks of the city. Any person so offending shall be fined in any sum not exceeding five dollars for each offense.
Sec. 27. Any person who shall, upon any street, alley or public place in this city, employ any device, speech, loud talk, noise or performance tending to gather crowds of persons, or obstruct such street, alley or other public place, shall, upon conviction, be fined in a sum of not less than ten nor more than one hundred dollars for each offense.

Sec. 28. That any person or persons who shall open any gate or other opening to, or tear down, any fence or enclosure around any place made or adopted by the city authorities as a city pound, or shall attempt to break down or open the same, or shall take out or let out, or attempt to take or let out, any animal or animals impounded therein by any city officer, shall be fined in a sum of not less than five nor more than twenty-five dollars for each offense.
Sec. 29. Any person who shall set up any gun-shooting apparatus, or keep any such apparatus on any public street, sidewalk, alley or other public place in the city, shall be fined in a sum of not less than one nor more than twenty-five dollars.
Sec. 30. Any person who shall lead or drive any beast of burden, or ride, drive or propel any cart, wagon, buggy or vehicle of any kind on, over or against any sidewalk or footway, otherwise than at regular built crossings, or who shall permit any such animal or team to be on or over any sidewalk, or who shall hitch or fasten any animal to any well curb, fence post, awning post, or lamp post, unless permission be given by the owner, shall be fined a sum not exceeding fifty dollars for each offense.
Sec. 31. It shall be unlawful for any person to hitch any horse, mule or other animal to any well curb, fence, shade tree, sign post, awning post, or other structure, unless permission be given by the owner thereof. Any person violating the provisions of this section shall be fined in a sum not exceeding five dollars for each offense.
Sec. 32. It shall be unlawful for any person to water horses, mules, cattle, or other stock at any well in the city, except by the proprietor or lessee thereof, or with the permission of such proprietor or lessee; provided, it shall be the duty of any owner or lessee of any well who may desire to prevent such watering of stock at his or their well, to post in some conspicuous place at or near said well a written or printed notice prohibiting the same. Any person violating the provisions of this section shall, upon conviction thereof, be fined in any sum not less than two nor more than five dollars.
Sec. 33. Any person or persons who shall tear up or injure any sidewalk or crosswalk, or shall obstruct any crosswalk by animals or vehicles standing or remaining thereon, shall, upon conviction, be fined in a sum of not more than one hundred dollars.
Sec. 34. It shall be unlawful for any person or persons to encroach into or upon the sidewalks, streets, avenues, alleys, or other public grounds of the city by building fences thereon or otherwise, except by express permission of the City Council; and any person violating the provisions of this ordinance shall be fined in a sum not exceeding one hundred dollars for each and every offense.
Sec. 35. Any person or persons in this city who shall, on the streets, alleys, or sidewalks, play at any game of amusement, or engage in any sport or exercise likely to scare horses or mules, injure passengers, or embarrass the passage of vehicles or persons, shall, upon conviction, be fined in a sum of not more than one hundred dollars.
Sec. 36. Any person or persons who shall willfully plow any street, alley, or any vacant lot, without the consent of the owner, in the City of Troy, shall, upon conviction, be fined in any sum not less than two nor more than ten dollars for each time he shall so offend.
Sec. 37. Any person who, in this city, shall hack or otherwise injure any lamp post, awning, spouting, door, window, railing, porch, sign or fence belonging to another, or shall willfully cut, hack, or otherwise injure any ornamental or shade tree standing upon any sidewalk, street or public ground, shall, upon conviction thereof, be fined not less than three nor more than twenty-five dollars.
Sec. 38. Any person who shall, in this city, willfully, maliciously, or without lawful authority, cut down, root up, pull up, or otherwise injure or destroy any fruit, shade, or ornamental tree, cultivated root or plant, grape or strawberry vine, or other plant, vine or shrub whatsoever, the property of another, or shall pick, destroy, or carry away therefrom, or from any tree or plant standing on or attached to the land of another, any part of the fruit thereof, or shall trespass upon the premises of another without lawful authority, shall, upon conviction thereof, be fined in any sum not exceeding fifty dollars.
Sec. 39. It shall be unlawful for boys under the age of sixteen years to loaf, play, run, or loiter upon the business streets of the city, or upon the Public Square, or about the railroad depot after half-past nine o’clock at night, between the first day of May and the first day of October, and after eight o’clock, between the first day of October and the first day of May; and each person so offending shall, upon conviction, be fined in any sum not exceeding ten dollars.
Sec. 40. It shall be unlawful for any person owning or having control of any horse, mule, or other beast of burden to permit any such animal to remain hitched or standing upon any of the public streets, alleys, or public places after twelve o’clock at night; and any person so offending shall, upon conviction thereof, be fined in any sum not exceeding ten dollars for each animal thus remaining standing or hitched. The Marshal shall take up any such animal and feed and keep the same in some stable, and shall be allowed the sum of fifty cents for taking up such animal, together with charges for keeping the same, and shall retain such animal until such fee and costs are paid.
Sec. 41. It shall be unlawful for any person to obstruct any pavement, street, or sidewalk in front of his or her premises by placing any boxes, barrels, wood, merchandise, or other obstruction thereon, or permit the same to be done; and every person so offending shall, upon conviction, be fined in any sum not exceeding twenty dollars.
This ordinance shall take effect and be in force from and after its publication in pamphlet form.

Ordinance No. 21
An Ordinance Relating to Peddlers
Be it ordained by the Mayor and Councilmen of the City of Troy:
Sec. 1. Every person who shall sell or offer for sale, in this city, any goods, wares, merchandise, or article of trade at any place upon or along any street or alley, by going from place to place to sell the same, shall be deemed a peddler.
Sec. 2. It shall not be lawful for any peddler to exercise his calling within the limits of this city without first obtaining a license therefor; and any person violating this section shall be fined in any sum not less than one nor more than twenty-five dollars for each day such violation shall occur. Provided, that this ordinance shall not apply to hucksters of produce and vegetables.
Sec. 3. Any person desiring a license as a peddler may obtain the same from the City Clerk by paying therefor as follows:
- Each license, one day — $1.00
- Three days — $3.00
- One week — $5.00
Sec. 4. Any person licensed as aforesaid who shall be guilty of any fraud, cheat, misrepresentation, or imposition while acting in such capacity shall, upon conviction thereof, be fined in any sum not less than five nor more than fifty dollars.
Sec. 5. The City Clerk shall receive the sum of twenty-five cents as a fee for each license issued under this ordinance, to be paid by the person taking out the same.
Sec. 6. This ordinance shall take effect and be in force from and after its publication in pamphlet form.
