Ordinance No. 198

An ordinance letting the contract for grading, repairing, curbing, guttering, draining and otherwise improving the following streets:

Poplar Street from Main Street to Centre Street.
Centre Street from Poplar Street to State Street.
State Street from Centre Street to Park Street.
Park Street from State Street to Jones Street.
Jones Street from Park Street to County Road.

Witnesseth: Under the provisions of Ordinance No. 195 passed and approved on the 7th day of September, 1920, the Mayor and Council determined to grade, repair, pave, curb and gutter, drain and otherwise improve certain streets in the City of Troy, Kansas and within the limits set forth as follows:

Poplar Street from the west line of Main Street to the west line of Centre Street to a width of thirty

Centre Street from the south line of Poplar Street to the north line of State Street to width of thirty (30) feet.

State Street from the east line of Centre Street to the west line of Park Street to a width of thirty (30) feet.

Park Street from the north line of State Street to the south line of Jones Street to a width of thirty (30) feet.

Jones Street from the west line of Park Street to the east line of Country Road to a width of thirty (30) feet.

Whereas, plans and specifications for the constructing of the improvements as prepared by the City’s Engineer are now on file with the City Clerk as provided in Ordinance No. 195 said plans having been adopted and approved by the Mayor and Council; and

Whereas, proposals for doing such grading, repairing, curbing, guttering and draining and otherwise improving said streets have been filed with the City Clerk in accordance with Ordinance No. 197 and such proposals have been examined by the Mayor and Councilmen and proposal or bid of P. C. Candee and Company is hereby found and determined to be the best satisfactory proposal for the said improvements, and that the prices named in said proposals are found to be less than the estimated cost of said improvements as made by the City’s Engineer and on file with the City Clerk;

Therefore, Be it ordained by the Mayor and Councilmen of the City of Troy, Kansas:

Sec. I. That the contract be and is hereby let to P. C. Candee and Company of Kansas City, Mo. for the grading, repairing, curbing and guttering, paving, draining and said streets in accordance with the schedule of quantities as set forth in the plans and specifications on file with the City Clerk; said schedule to represent a complete job, itself, all of the items for unit set forth in the bidders blank; it is further found hereto attached and forming a part hereof for which work contractor shall be paid at the rate stipulated in his bid for the actual quantities as computed by the City’s Engineer.

Sec. II. That such contractor is awarded upon express condition that the work and improvements herein awarded shall be done in accordance with plans and specifications of the City’s Engineer, and made a part of this contract and upon further condition among others that said P. C. Candee & Company, contractors, shall within fifteen (15) days from this date execute a written contract with said City, giving the City surety bonds as follows:

A contract bond in amount equal to approximately 50 per cent of the contract.

A statutory bond in amount equal to 100 per cent of the contract.

A maintenance bond equal to 10 per cent of the contract guaranteeing maintenance for a period of three years after such improvements shall have been accepted by the City.

Sec. III. This ordinance shall take effect and be in force from and after its passage and publication in the Kansas Chief as required by law.
