Ordinance No. 195
An ordinance providing for the grading, repairing, paving, curbing and guttering, draining and otherwise improving the following streets, in the City of Troy, Kansas.
Maple Street from Main Street to Centre Street.
Centre Street from Maple Street to State Street.
State Street from Centre Street to Park Street.
Park Street from State Street to Union Street.
Union Street from Park Street to Country Road.
Designating the width of roadway.
Providing for the preparation of plans and specifications, estimated cost, thereto, letting of contract therefor and the manner of payment for said improvement.
Witnesseth: By a resolution duly adopted on the 7th day of October, 1919, the Mayor and Council of the City of Troy, Kansas, declared that they deemed it necessary to grade, repair, pave, curb and gutter, drain and otherwise improve the above said streets within the limits set forth, and
Whereas, said resolution was published four (4) consecutive weeks in the Kansas Chief a weekly newspaper published in the City of Troy, Kansas, and
Whereas, a majority of the resident owners of property liable to assessment and taxation for the cost of said improvements did not within twenty (20) days from the last publication of such resolution, file with the City Clerk of said City their protest against such improvements or the making thereof; therefore
Be it ordained by the Mayor and Councilmen of the City of Troy, Kansas:
Sec. 1. That it is hereby declared necessary and the Mayor and Councilmen are hereby authorized, empowered and directed to order the following streets within the limits outlined shall be graded, repaired, paved, curbed and guttered, drained and otherwise improved to a road between face of curbs as hereinafter set forth. Improvements to be made with such material as hereinafter provided, and according to the plans and specifications of the City Engineer of said City of Troy, Kansas as hereinafter provided. The foresaid streets shall be improved with in the limits and to the width as follows:
Poplar Street from the west line of Main Street to the west line of Centre Street to a width of thirty (30) feet
Centre Street from the south line of Poplar Street to the north line of State Street to a width of thirty (30) feet.
State Street from the east line of Centre Street to the west line of Park Street to a width of thirty (30) feet.
Park Street from the north line of State Street to the south line of Jones Street to a width of thirty (30) feet.
Jones Street from the west line of Park Street to the east line of Country Road, to a width of thirty (30) feet.
Sec. II. For the work and improvements herein provided for, the City Engineer shall make and file with the City Clerk on or before the 10th day of September, 1920, complete plans, profiles and specifications and estimate cost for the improvements of the above mentioned streets as follows:
A three course vitrified Brick with asphalt filler and sand cushion on five (5) inch concrete base.
Combination six (6) inch curb and thirty (30) inch gutter of concrete.
Double gutter thirty six (36) inches by six (6) inch.
Vitrified cement of drain tile and catch basins.
Excavation, grading and all other improvements essential to paving contemplated.
Sec. III. That after such plans shall have been prepared by the City Engineer and filed with the City Clerk as aforesaid, the Mayor and Council may advertise for the receiving of bids for the paving of said streets, for the grading and repairing of said streets, for the curbing and guttering of said streets, and for the draining of said streets as contemplated, and after the acceptance of such bids and proposals, the Mayor and Council are hereby authorized and empowered to let the contract for the improvements of said streets as aforesaid to the most satisfactory and responsible bidder as determined by said Mayor and Council, reserving the right to let the contract or reject any and all bids as they see fit.
Sec. IV. After the passage of this ordinance the Mayor and Councilmen shall cause three (3) disinterested householders who, after having taken the oath to faithfully and impartially appraise all lots and pieces of ground liable to taxation and assessment for the cost of the improvements herein provided for said within ten days after having received notice of their appointment, proceed to appraise said lots and pieces of ground liable to assessment and taxation as aforesaid without regard to the buildings or improvements thereon, and after making said appraisement shall return the same to the Mayor and Council at the first meeting thereof. After such appraisement shall have been completed, and after such appraisement is returned to the Mayor and Council, the said Mayor and Council shall designate a time for holding a special session for the purpose of hearing complaints and equalizing said appraisement of which special session due notice shall be given in the official City paper; and at said special session the Mayor and Council shall if they deem it just and proper, alter or change such appraisement.
Sec. V. For the purpose of paying for the work and improvements in the Ordinance provided for, the Mayor and Council are hereby authorized and directed to issue bonds of the City of Troy, Kansas, in an amount not to exceed the contract price and cost of such improvements, and to run for a period of ten years and be payable in ten equal annual installments together with interest not to exceed six (6) per cent per annum, which bonds shall be made payable at the fiscal agency of the State of Kansas; and that for the purpose of paying principal and interest on said bonds as they severally become due and payable, the Mayor and Council shall apportion and assess against the lots and pieces of ground within the taxing district of such improvements special assessments covering the cost of such improvements and apportionment therein contained shall hold good for all the installments that are to be collected from the specific property chargeable with said improvement. Such assessments and apportionment ordinance shall contain the total amount of tax apportioned to each lot, tract or piece of ground within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereupon the City Clerk shall annually at the same time as other taxes are certified, certify to the County Clerk of Doniphan County, Kansas, a full list of all property with the taxing district of said improvement together with the respective amounts due on each of said tracts, pieces and parcels of ground, which amount shall include the annual installments and interest on all unpaid balances for one year at the rate of six per cent per annum and such amounts so certified shall be collected as other taxes are collected. Provided that for the purpose of paying the cost of improving the squares and areas formed by the crossing of streets and alleys, as well as where the improvement is stopped or adjacent to property of the City for which City would be liable, the assessment shall be made against all the taxable property of the City.
Sec. VI. This ordinance shall take effect and be in full force from and after its passage and publication once in the Kansas Chief.
