Ordinance No. 185

An ordinance making and levying a special assessment on all the lots, blocks and parcels of ground hereinafter described liable for the costs and expenses of grading, curbing, guttering and paving, except the squares and areas formed by the crossing and intersecting streets, of Poplar, Chestnut, Walnut, Myrtle and Elm Streets from the east side of Main Street to the west side of Liberty Street in the City of Troy, Kansas.

Be it ordained by the Mayor and Councilmen of the City of Troy, Kansas:

Sec. I.

That for the purpose of paying the costs and expenses of grading, curbing, guttering and paving Poplar, Chestnut, Walnut, Myrtle and Elm Streets, from the east side of Main Street to the west side of Liberty Street, except the squares and areas formed by crossing and intersecting streets, in the City of Troy, Kansas, the following described lots, blocks and parcels of ground are hereby assessed the amounts set opposite said lot, block or parcel of ground respectively, as the proportion of the cost and expense of said assessment to be paid by the owners of said lot, block or parcel of ground, to wit:

Sec. II.

Said apportionment, levy and assessment shall be due and collectable in ten equal installments, the first installment becoming due in 1921, and one of said installments shall become due each and every year thereafter until the entire number are paid, and all unpaid installments to draw interest as herein provided, and shall be collected as other taxes are collected; provided, that the owner of any piece of property liable for any such special assessment may redeem his property from such liability at any time within thirty (30) days from the time when this ordinance shall take effect, and the City Clerk is hereby directed to mail to each owner a written or printed notice describing therein the lot and the amount of the special assessment, and if within thirty days the entire amount of the special assessment on any lot, block or parcel of ground shall be paid in full, such property shall not thereafter be liable for any further assessment for the cost or expense of such improvements.

Sec. III.

That there is hereby further levied and assessed against each lot, block and parcel of ground described in Section One of this ordinance six percent (6%) per annum on all of said installments save those which are paid in full within thirty days from the time this ordinance shall go into effect, and said interest to run from the date when the said improvement bonds shall be issued until the payment of each installment as provided herein, all of which shall be collected annually at the same time and in the same manner as said installments.

The City Clerk shall, at the time and in the manner as provided by law for certifying of taxes for the year 1920, and annually thereafter until said installments are paid in full, certify to the County Clerk of Doniphan County, Kansas, a list of lots, blocks and parcels of ground liable for the costs and expenses of said improvements and on which the assessments or taxes set out herein have not been paid, together with the interest on the unpaid installments at the rate of six percent per annum, and such amount so certified shall be collected as other taxes are collected, and the money so collected shall be applied toward the redemption of the improvement bonds which may be issued for said improvements and toward reimbursing the City of Troy when such bonds or any part thereof are redeemed from general taxes.

Sec. IV.

This ordinance shall take effect and be in full force from and after its publication in the Kansas Chief, Troy, Kansas.
