Ordinance No. 172
An ordinance providing for the grading, excavating, paving, curbing and guttering, draining and otherwise improving the following streets:
- Main Street, from the St. Joseph and Grand Island Railway tracks to the north line of Locust Street.
- Liberty Street, from the St. Joseph and Grand Island Railway tracks north to the north line of Locust Street.
- Poplar Street, Chestnut Street, Walnut Street, Myrtle Street, Elm Street, from the east line of Main Street to the west line of Liberty Street.
- First Street, from the south line of Myrtle Street to the north line of Locust Street, and Second Street, from the south line of Walnut Street to the city limits, thence east to the alley between Second and Third Streets.
- Myrtle Street, from the east line of
Liberty Street to the west line of Second Street.
Boone Street, from the east line of Liberty Street to the west line of Second Street.
Walnut Street, from the east line of First Street to the west line of Second Street.
All in the City of Troy, Kansas, and providing for the cost thereof, letting contracts therefor and the manner of payment.
Whereas, by a resolution duly adopted on the 7th day of October, 1919, the Mayor and Council of the City of Troy, Kansas, declared that they deemed it necessary to grade, excavate, pave, curb and gutter, drain and otherwise improve the above said streets within the limits set forth; and,
Whereas, said resolution was published four (4) consecutive weeks in the Kansas Chief, a weekly newspaper published in the City of Troy, Kansas; and,
Whereas, a majority of the resident owners of property liable to assessment and taxation for the cost of said improvements did not, within twenty (20) days from the last publication of such resolution, file with the City Clerk of said City their protest against such improvements to the making thereof;
Therefore,
Be it ordained by the Mayor and Councilmen of the City of Troy, Kansas:
Sec. I.
That it is necessary and is hereby ordered and directed that the following streets within the limits outlined shall be graded, excavated, paved, curbed and guttered, drained, and otherwise improved to a width between faces of curbs as hereinafter set forth, provided that at the intersections of streets and alleys such paving shall extend to the lot line of said street so improved; improvements to be made with such material as the Mayor and Councilmen may hereinafter designate and select as hereinafter provided, according to the specifications of the City Engineer of said City of Troy, Kansas, as hereinafter provided, to wit:

Main Street, from the St. Joseph and Grand Island Railway tracks to the north line of Myrtle Street, to a width of sixty (60) feet; thence to the north line of Locust Street to a width of twenty-four (24) feet.

Liberty Street, from the St. Joseph and Grand Island Railway tracks to the south line of Chestnut Street, to a width of thirty (30) feet; thence to the north line of Walnut Street to a width of sixty (60) feet; thence to the north line of Locust Street to a width of twenty-four (24) feet.

Poplar Street, from the east line of Main Street to the west line of Liberty Street, to a width of twenty-four (24) feet.
Chestnut Street, from the east line of Main Street to the west line of Liberty Street, to a width of sixty (60) feet.
Walnut Street, from the east line of Main Street to the west line of Liberty Street, to a width of sixty (60) feet.
Myrtle Street, from the east line of Main Street to the west line of Liberty Street, to a width of twenty-four (24) feet.
Elm Street, from the east line of Main Street to the west line of Liberty Street, to a width of twenty-four (24) feet.

First Street, from the south line of Myrtle Street to the north line of Locust Street, to a width of twenty-four (24) feet.
Second Street, from the south line of Walnut Street to the City Limits, and east along the City Limits to the alley between Second and Third Streets, to a width of twenty-four (24) feet.
Myrtle Street, from the east line of Liberty Street to the west line of Second Street, exclusive of intersections at First Street, to a width of twenty-four (24) feet.
Elm Street, from the east line of Liberty Street to the west line of Second Street, exclusive of intersections at First Street, to a width of twenty-four (24) feet.
Locust Street, from the east line of First Street to the west line of Second Street, exclusive of intersections at First Street, to a width of twenty-four (24) feet.
Sec. II.
For the work and improvements herein provided for, the City Engineer shall make and file with the City Clerk, on or before the 6th day of January, 1920, specifications and estimates of the cost divided into schedules outlined under Section I, for the improvements of the above-mentioned streets.
The streets shall be improved with one of the following types of construction:
- Vertical brick with asphalt filler and sand cushion on a 5-inch concrete base.
- Asphaltic concrete wearing surface on a 5-inch concrete base.
- Single-course concrete pavement, consisting of an 8-inch curb and 30-inch gutter of concrete.
Drains shall consist of storm sewers, manholes, and catch basins.
Excavation, grading, and all other improvements essential to the paving contemplated, also sufficient water mains under the proposed pavement as shown on plans for the construction of a future water system.
Sec. III.
That after such plans and specifications shall have been prepared by the City Engineer and filed with the City Clerk as aforesaid, the Mayor and Council may advertise for bids for paving of said streets, for the different kinds of paving materials named and specified in the preceding section hereof, and for the curbing and guttering, draining and storm sewering, grading and paving; and after the reception of such bids or proposals, the Mayor and Councilmen shall select from the different kinds of street paving material on which bids were asked, the kind which in their judgment said streets should be paved, and may and are hereby authorized and directed to let contracts in accordance with schedules or divisions as outlined in Section No. I, for the paving of said streets with the materials so selected, and for the curbing and guttering, draining, sewering, excavating and grading to the most satisfactory and responsible bidders as determined by the said Mayor and Council.
Sec. IV.
After the passage of this ordinance the Mayor and Council shall appoint three disinterested householders, who, after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to taxation and assessment for the cost of improvement herein provided for, shall, within ten days after having been notified of their appointment, proceed to appraise such lots and pieces of ground liable to assessment and taxation, as aforesaid, with reference to the building or improvements pieces or parcels of land, which amount shall include the annual installments and interest on all unpaid balances for one year at the rate of five percent (5%) per annum, and such amounts so certified shall be collected as other taxes are collected.
Provided, that for the purpose of defraying the cost of improving the squares and areas formed by the crossing of streets and alleys, as well as where the improvement is thrown for assessment to property of the City, for which the City would be liable, the assessments shall be made against all the taxable property of the City.
Sec. VI.
This ordinance shall take effect and be in full force from and after its passage and publication once in the Kansas Chief, the City paper.
