An Ordinance Relating to the Enforcement of Fines and Forfeitures.
Be it ordained by the Mayor and Councilmen of the City of Troy:
SEC. 1. That when any person shall fail to pay, or fail to secure the payment, within five days, of any fine that may be adjudged against him under any ordinance of this city, together with the costs that have accrued in his case, he shall be immediately committed to the city prison for safe keeping.
SEC. 2. Persons thus committed may be compelled to work at hard labor, either on the streets or in any public place within the city where employment can be found for such persons, until such fine and costs are paid, under the direction of the City Marshal.
SEC. 3. Such persons shall not be compelled to work more than eight hours per day, and for each day’s work performed shall be credited one dollar upon the judgment upon which the commitment was made; and when the judgment and costs are satisfied by such work, he shall be discharged from custody.
SEC. 4. Such persons may be secured by such chain or other means as may be necessary to prevent escape, and the Marshal shall have charge of such persons during the time they may be employed at such labor, and compel them to work under his care or direction.
SEC. 5. The Marshal shall cause such persons, while working or during confinement, to be fed three meals per day of plain and wholesome food at the expense of the city.
SEC. 6. Any person liable to be set at labor under the provisions of this ordinance who shall refuse to work when ordered shall be kept in close confinement and shall receive no credit upon the judgment against him for any day on which he refuses to work; provided, that persons imprisoned under this ordinance shall be kept in confinement until released by order of the Mayor and Council.
Provided, further, that any person imprisoned for any offense against the city who is willing and offers to work out his fine, and who is not furnished with work or labor by the Marshal, shall be credited on his fine the same as though he had actually worked out the same.
SEC. 7. The City Marshal shall be the judge of the sufficiency of any bond or security offered under Section 1 of this ordinance, and all bonds taken by him shall be made payable to the City of Troy; and the Marshal shall be liable to the city for the fine and costs if any insufficient bond or security be taken.
SEC. 8. This ordinance shall take effect and be in force from and after its publication in pamphlet form.
