Ordinance No. 135

An Ordinance relating to tobacco and cigarettes.

Be it ordained by the Mayor and Councilmen of the City of Troy:

Sec. I. It shall be unlawful for any person, company or corporation in the City of Troy to sell or give away any cigarette or cigarettes, cigarette paper or papers, or to have any cigarettes or cigarette paper in or about any store or other place of business for free distribution or sale.

Sec. II. Every person, company or corporation violating any of the provisions of Section One (1) of this ordinance shall, upon conviction, be fined not less than Twenty-five ($25.00) dollars nor more than One Hundred ($100.00) dollars.

Sec. III. It shall be unlawful for any minor person in the City of Troy to smoke or use any cigarette or cigarettes, cigars or tobacco in any public road, street, alley, park or school land used for public purposes, or in any public place; and any person violating any of the provisions of this section shall, upon conviction, be fined in any sum of not more than Ten ($10.00) dollars.

Sec. IV. It shall be unlawful for any person to furnish any cigarette or cigarettes, cigars or tobacco in any form to any minor person in the City of Troy, or to permit any such minor person to frequent any premise or premises owned, held or managed by him or her in said City, for the purpose of indulging in the use of any cigarette or cigarettes, cigars or tobacco in any form; and any person violating any of the provisions of this section shall, upon conviction, be fined not less than Twenty-five ($25.00) dollars nor more than One Hundred ($100.00) dollars.

Sec. V. It shall be unlawful for any person to light with fire or smoke any cigarette, cigar, pipe or tobacco in any form at the door or entrance of any church, opera house or public hall or room in the City of Troy, when persons are assembling in and at or leaving said place; and any person violating any of the provisions of this section shall, upon conviction, be fined in any sum not more than Ten ($10.00) dollars.

Sec. VI. This ordinance shall take effect and be in full force from and after its publication in the Weekly Kansas Chief.
