An Ordinance, Relating to Street Commissioner.
it ordained by the Mayor and Councilman of the City of Troy. That the Mayor-shall appoint, annually, by and with the consent of the City Council a Street Commissioner,
Those duty it shall be to have a general supervision of the streets, lanes, alleys; and the sidewalks in the city, to see that they are kept in proper repair, and free from rubbish, and obstruction and pit falls, and to see that the gutters are unobstructed, and free from filth and dirt; and for these purposes and any other, he may employ, by and with the consent of the Council, a sufficient number of horses and carts, laborers and mechanics and at such prices as the Mayor and Councilmen shall fix upon: and for what expended; and shall render earth month and oftener when required, detailed accounts there of to the Mayor and City Council.
Sec.2.
It shall further be the duty of the Street Commissioner to superintend all local inprovements of a public character with in the city, and to perform such other duties as the Council may impose upon him.
Sec. 3.
When the sidewalk or part thereof shall become obstructed with earth, broken, or otherwise out of repair, or when the mayor and Council shall direct and order a new side walk to be built in any part of the city, it shall be the duty of the Street Commissioner to notify and direct the owners, and holders of the adjacent real estate to repair or build the same, and if such repairs are not made, with in ten days after such a notice is given, such Commissioner shall proceed to have the building or repairs made, and report the expenses to the City Council, which shall be assessed as a special tax against said adjacent real estate and collected therefor as is or may be provided by ordinance.
Sec 4.
When the City Council shall believe any work in progress under the Street Commissioner to be unnecessary, or injurious to the interests of the city, any member of the Council shall thereupon discontinue the same, and at the next meeting of the City Council, said member shall report his objections to the same, and the Council shall thereupon make such order in the premises as they shall deem proper.
Sec 5.
This ordinance shall take effect and be in force from and after its publication in pamphlet form.
