An Ordinance Relating to the Duties and Salary of City Marshal, and Repealing Ordinances Nos. 17 and 64.
Be it ordained by the Mayor and Councilmen of the City of Troy:
SEC. 1. It shall be the duty of the City Marshal to cause the public peace to be preserved, and to see that all laws and ordinances of the city are enforced; and when any violation thereof shall occur, he shall arrest, or cause to be arrested, the offender, and detain him in custody in the city prison or other safe place within the city until he can be brought and duly examined before the Police Judge of the city; and it shall be his further duty to procure the necessary evidence for the successful prosecution of such offense.
SEC. 2. In cases of resistance the Marshal may call to his aid and command the assistance of all bystanders and others in the vicinity.
SEC. 3. The City Marshal shall pay over to the City Treasurer all sums of money collected by him for the city once in every two weeks, and his official bond shall be forfeited by the first neglect or failure of the Marshal to pay over all moneys as provided in this section.
SEC. 4. The City Marshal shall receive such sum per month as the Mayor and Council may from time to time declare for performing the duties of police, and he shall receive such fees as are allowed him in cases of arrest and conviction of offenders, which fees shall be the same as are allowed constables in similar cases, to be taxed as costs; provided, that in no case shall they be taxed against the city.
SEC. 5. Original Ordinances Nos. 17 and 64 are hereby repealed.
SEC. 6. This ordinance shall be in force from and after its publication in pamphlet form.
