ORDINANCE 719
AN ORDINANCE REGULATING TRAFFIC WITHIN THE CORPORATE LIMITS OF THE CITY OF TROY, KANSAS; INCORPORATING BY REFERENCE THE “STANDARD TRAFFIC ORDINANCE FOR KANSAS CITIES”, EDITION OF 2020; AMENDING SECTION 33 OF SAID STANDARD TRAFFIC ORDINANCE FOR KANSAS CITIES, EDITION OF 2020, RELATING TO MAXIMUM SPEED LIMITS; ADDING NEW SUB‑SECTIONS F AND G TO SECTION 85 OF SAID STANDARD TRAFFIC ORDINANCE RELATING TO THE STOPPING, STANDING OR PARKING OF CERTAIN TRUCKS, TRAILERS AND VEHICLES IN AREAS OF THE CITY ZONED RESIDENTIAL; INCORPORATING BY REFERENCE THE TERMS AND PROVISIONS OF K.S.A. 8-1567a CONCERNING DRIVING UNDER THE INFLUENCE OF ALCOHOL OR DRUGS AND RELATING TO BLOOD ALCOHOL CONCENTRATIONS OF PERSONS UNDER TWENTY-ONE YEARS OF AGE; AND REPEALING ORDINANCE 714 AND ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF TROY:
SECTION 1. INCORPORATING STANDARD TRAFFIC ORDINANCE.
There is hereby incorporated by reference for the purpose of regulating traffic within the corporate limits of the City of Troy, Kansas, that certain standard traffic ordinance known as the “Standard Traffic Ordinance for Kansas Cities”, Edition of 2020, prepared and published in book form by the League of Kansas Municipalities, Topeka, Kansas. No fewer than three copies of the Standard Traffic Ordinance shall be marked or stamped “Official Copy as Adopted by Ordinance No. 719”, and to which shall be attached a copy of this ordinance and filed with the City Clerk to be open to inspection and available to the public at all reasonable hours. The police department, municipal judge and all administrative departments of the City charged with enforcement of the ordinance shall be supplied, at the cost of the city, such number of official copies of the Standard Traffic Ordinance similarly marked, as may be deemed expedient.
SECTION 2. AMENDMENT OF SECTION 33 OF THE STANDARD TRAFFIC ORDINANCE FOR KANSAS CITIES, EDITION OF 2020.
Section 33 of the Standard Traffic Ordinance for Kansas Cities, Edition of 2020, is hereby amended to provide as follows:
ASec. 33. Maximum Speed Limits.
(a) Except as provided in subsections (b) and (c) and except when a special hazard exists that requires lower speed for compliance with K.S.A. 8-1557, and amendments thereto, the limits specified in this subsection or established as authorized by law shall be maximum lawful speeds, and no person shall operate a vehicle at a speed in excess of 20mph:
(b) (1) The maximum speed limit for that portion of Locust Street between Last Chance Road and Third Street shall be 35 miles per hour;
(2) The maximum speed limit for that portion of Locust Street between Third Street and the East City Limit of the City of Troy, Kansas shall be 45 miles per hour;
(3) The maximum speed limit for that portion of Last Chance Road located within the corporate limits of the City of Troy, Kansas shall be 45 miles per hour.
(c) No person shall drive a school bus to or from school, or interschool or intraschool functions or activities, at a speed in excess of the maximum speed limits for the operation of such district=s school buses. The provisions of this subsection relating to school buses shall apply to buses used for the transportation of students enrolled in community colleges or area vocational schools, when such buses are transporting students to or from school, or functions or activities. (d) The maximum speed limits in this section may be altered as authorized in K.S.A. 8-1559 and K.S.A.8-1560, and amendments thereto.
SECTION 3. INCORPORATING TERMS AND PROVISIONS OF K.S.A. 8-1567(a).
The terms and provisions of K.S.A. 8-1567a, as amended, are hereby incorporated by reference for the purpose of regulating the operation of motor vehicles by persons under twenty-one years of age who have a breath or blood alcohol content of .02 or greater.
SECTION 4. PARKING BY CERTAIN TRUCKS, TRAILERS AND VEHICLES IN RESIDENTIAL AREAS PROHIBITED.
Section 85 of the aforesaid Standard Traffic Ordinance is hereby amended to include new subsections (f) and (g) which subsections shall provide as follows:
(f) Subject to the provisions of Section 85 of the aforesaid Standard Traffic Ordinance for Kansas Cities which provides for limited short term parking for the purpose of loading and unloading commercial and delivery trucks, no person shall stand or park, or stop except to obey traffic signs or signals, any truck rated one ton or greater, or any vehicle, trailer, or semi-trailer which has dual wheels, or any trailer with more than one axel, along streets, alleys or other public thoroughfares or roadways within any area of the City of Troy, Kansas, which is zoned for residential use. The provisions hereof relating to vehicles with dual wheels shall not apply to pickup trucks equipped with dual wheels, nor shall it apply to school buses parked in the location and under the circumstances hereinafter provided for in sub-section (g).
(g) School buses involved in the transportation of students for school activities or functions shall be permitted to park on the South side of West Chestnut Street between Last Chance Road and South Park Street, and on the west side of South Park Street between West Chestnut Street and West State Streets, while the students transported by the bus(es) are preparing for, participating in or getting ready to depart from school activities or functions.
SECTION 5. REPEAL.
Ordinance No. 714 and all other ordinances of the City of Troy, Kansas in conflict herewith are hereby repealed.
SECTION 6. EFFECTIVE DATE.
This ordinance shall take effect and be in force from and after its publication in The Kansas Chief, the official City Newspaper.
