Ordinance No. 175
An ordinance letting the contract for the grading, excavating, paving, curbing, guttering, draining and otherwise improving the following streets:
- Main Street, from the St. Joseph & Grand Island Railway tracks to the north line of Locust Street.
- Liberty Street, from the St. Joseph & Grand Island Railway tracks to the north line of Locust Street.
- Poplar Street, Chestnut Street, Walnut Street, Myrtle Street, and Elm Street, from the east line of Main Street to the west line of Liberty Street.
- First Street, from the south line of Myrtle Street to the north line of Locust Street.
- Second Street, from the south line of Walnut Street to the City Limits.
- Myrtle Street, from the east line of Liberty Street to the west line of Second Street.
- Elm Street, from the east line of Liberty Street to the west line of Second Street.
- Locust Street, from the east line of First Street to the west line of Second Street.
All in the City of Troy, Kansas.
Whereas, under the provisions of Ordinance No. 172, passed and approved on the 6th day of January, 1920, the Mayor and Council deemed it necessary to grade, excavate, and pave certain streets in the City of Troy, Kansas, designated under separate schedules as follows:
Schedule No. 1
Main Street, from the St. Joseph & Grand Island Railway tracks to the north line of Myrtle Street, to a width of sixty (60) feet; thence to the north line of Locust Street to a width of twenty-four (24) feet.
Schedule No. 2
Liberty Street, from the St. Joseph & Grand Island Railway tracks to the south line of Chestnut Street, to a width of thirty (30) feet; thence to the north line of Walnut Street to a width of sixty (60) feet; thence to the north line of Locust Street to a width of twenty-four (24) feet.
Schedule No. 3
Poplar Street, from the east line of Main Street to the west line of Liberty Street, to a width of twenty-four (24) feet.
Chestnut Street, from the east line of Main Street to the west line of Liberty Street, to a width of sixty (60) feet.
Walnut Street, from the east line of Main Street to the west line of Liberty Street, to a width of sixty (60) feet.
Myrtle Street, from the east line of Main Street to the west line of Liberty Street, to a width of twenty-four (24) feet.
Elm Street, from the east line of Main Street to the west line of Liberty Street, to a width of twenty-four (24) feet.
Schedule No. 4
First Street, from the south line of Myrtle Street to the north line of Locust Street, to a width of twenty-four (24) feet.
Second Street, from the south line of Walnut Street to the City Limits, to a width of twenty-four (24) feet.
Myrtle Street, from the east line of Liberty Street to the west line of Second Street, exclusive of intersections at First Street, to a width of twenty-four (24) feet.
Locust Street, from the east line of First Street to the west line of Second Street, exclusive of intersections at First Street, to a width of twenty-four (24) feet.
Whereas, plans and specifications for making said improvements have been prepared by the engineers and are now on file with the City Clerk as provided for in said Ordinance No. 172, and the same have been adopted and approved by the City Council; and,
Whereas, proposals for doing such grading, excavating, paving, curbing and guttering, draining, have been filed with the City Clerk in accordance with Ordinance Nos. 172 and 173, and such proposals have been examined by the Mayor and Council, and the proposal of J. F. Cavender & Co. is hereby found and determined to be the most satisfactory for the grading, excavating, paving, curbing and guttering, draining hereinbefore designated for each and every schedule as hereinabove set forth, and that the prices named in such proposal are found to be less than the estimated cost of such improvements as heretofore made by the City Engineer and now on file with the City Clerk.
Therefore, be it ordained by the Mayor and Council of the City of Troy:
Sec. I.
That the Mayor and Council hereby determine that the streets set forth in Schedules 1, 2, 3 and 4 shall be paved with brick on a 5-inch concrete base, and otherwise improved as specified in the specifications of the City Engineer and filed by the City Engineer with the City Clerk on the 6th day of January, 1920, and such paving material laid as above specified is hereby adopted and selected as the material with which said streets shall be paved.
Sec. II.
That the contract be and is hereby let to J. F. Cavender Co., of Kansas City, Missouri, for the grading, excavating, paving, curbing and guttering, and draining of said streets in accordance with the schedules hereinbefore set forth, each schedule to represent a complete job in itself, all at the unit prices set forth in the bidders’ blank contract form hereto attached and made a part hereof, for which work the contractor shall be paid at the rate estimated in his bid for the actual quantities as computed by the City Engineer.
Sec. III.
That such contracts are awarded upon the express condition that the work and improvements thereunder shall be done in strict accordance with the specifications of the City Engineer, the same being hereby made a part of this contract, and of the contract hereby awarded; and upon the further condition, among others, that the said J. F. Cavender Co. shall, within fifteen (15) days from this date, execute a written contract with the City giving to the City a surety bond as follows:
- A Construction Bond in an amount equal to approximately fifty (50) percent of the contract.
- A Statutory Bond in an amount equal to 100 percent of the contract price.
- A Maintenance Bond equal to ten (10) percent of the contract, guaranteeing maintenance of the work for a period of three years after such pavements shall have been accepted by the City.
Sec. IV.
This ordinance shall take effect and be in force after its publication one time in the Kansas Chief.
