Clerk—City. No. 10. An Ordinance Relating to the Duties of the City Clerk. Be it ordained by the Mayor and Councilmen of the City of Troy: Section 1 Sec. 1. The City Clerk shall perform all the duties of clerk to the City Council, shall keep a record of all of their proceedings, and shall keep and preserve in his office all public documents, papers, official oaths and records belonging to the city; shall have charge of and preserve all deeds, mortgages, contracts, judgments, notes, bonds, debts and causes in action belonging to the city. Section 2 Sec. 2. The City Clerk shall record in suitable books all instruments of taxes for improving avenues, streets, lanes, alleys, etc.; all bonds issued by the city and all coupons attached thereto; all licenses granted by the City Council, with the date of the same, the amount paid therefor, and the time of their expiration; all drafts and orders issued on the City Treasurer, with the numbers, dates and amounts of the same and the names of the persons to whom they are issued; and all amounts allowed or ordered to be paid by the City Council, with the amounts and dates of allowance; he shall also attest the signature of the Mayor to all drafts, bonds, licenses, ordinances, commissions, etc.; he shall have and preserve the official seal of the city, and shall affix it to all such papers as may be required by ordinance. Section 3 Sec. 3. The City Clerk shall keep accurate accounts of all receipts and disbursements of money, funds and revenue of said city, in convenient books which shall be opened and kept in a proper manner; also, a particular personal account with each individual receiving any contract or performing any public work, giving each credit for the amount of work performed, and charging him with the amount of all orders issued in his favor, stating the particular contract, public work or account for which, or on which appropriation, the same shall have been made; he shall also keep an account with each of the officers of the City Government, crediting them with the amount of their salary or fees, as fast as the same becomes due, and charging each with all orders issued in his favor. Section 4 Sec. 4. The City Clerk shall make a quarterly report, between the 15th and 20th days of March, June, September and December, to the City Council, of the receipts and expenditures of the city during the quarter, and a full, accurate and detailed statement of the financial condition of the city, and shall perform all other duties which may be imposed upon him by the City Council. Section 5 Sec. 5. The City Clerk shall receive for his services a salary of twenty-five dollars per annum, payable quarterly, and such fees as may be prescribed by this and other ordinances; and all fees for issuing licenses not provided for by other ordinances shall be twenty-five cents. Business Licenses. No. 9. An Ordinance in Relation to Granting General Business Licenses. Be it ordained by the Mayor and Councilmen of the City of Troy: Sec. 1. That no person or co-partnership of persons shall do business within the City, as bankers, brokers, merchants of any kind, druggists, restaurant keepers not selling intoxicating drinks, eating houses, butchers, stove and tinware dealers, lumber dealers, furniture dealers, saddle or harness dealers, jewelers, livery stable keepers, life insurance companies or their agencies, and scales where a charge is made for weighing, without having first obtained a license therefor. Sec. 2. The said license shall be granted at the rate of five dollars per year; Provided, that any person paying said license tax shall be entitled to receive credit for that amount upon his city tax, upon presentation of the receipt to the County Treasurer. Sec. 3. That any person, persons, firms, companies, corporations, or co-partnerships doing business, or carrying on any business, trade or profession, who shall do business or carry on any such trade or profession in this city, without having first obtained a license therefor, and paid into the city treasury the amount required to be paid therefor, under the provisions of this ordinance, shall, upon conviction, be fined in a sum of not less … Summary This ordinance required a general annual business license for a broad range of commercial activities, including: Bankers and brokers Merchants Druggists Restaurants not selling intoxicating liquors Eating houses Butchers Stove and tinware dealers Lumber dealers Furniture dealers Saddle and harness dealers Jewelers Livery stables Life insurance companies and agents Public weighing scales charging a fee License Fee $5 per year Tax Credit Provision An unusual feature is that the $5 license fee could be credited against the payer’s city tax upon presenting the receipt to the County Treasurer. Sec. 3. That any person, persons, firms, companies, corporations, or co-partnerships doing business, or carrying on any business, trade or profession, who shall do business or carry on any such trade or profession in this city, without having first obtained a license therefor, and paid into the city treasury the amount required to be paid therefor, under the provisions of this ordinance, shall, upon conviction, be fined in a sum of not less than five dollars, nor more than one hundred dollars, for each offense. Bonds of Officers. No. 7. An Ordinance Requiring Certain Officers to Give Bonds Before Entering Upon the Duties of Their Offices. Be it ordained by the Mayor and Councilmen of the City of Troy: Sec. 1. That the following city officers shall give bond to the City of Troy, as hereinafter provided, before entering upon the duties of their respective offices. Sec. 2. The City Treasurer shall give bond in the sum of One Thousand Dollars. Sec. 3. The City Attorney shall give bond in the sum of Five Hundred Dollars. Sec. 4. The Police Judge shall give bond in the sum of Five Hundred Dollars. Sec. 5. The City Clerk shall give bond in the sum of Five Hundred Dollars. Sec. 6. The City Marshal shall give bond in the sum of Five Hundred Dollars. Sec. 7. The Street Commissioner shall give bond in the sum of Five Hundred Dollars. Sec. 8. Each of said bonds shall have one or more good and sufficient sureties, to be approved by the Mayor and Council, and shall be conditioned for the faithful performance by the officer executing the same, of all acts and duties required of him by any law of the State of Kansas, or of the City of Troy, and for the proper application and the payment of all money or property coming into his hands by virtue of said office; said bonds to be filed with the City Clerk (except the bond of the City Clerk, which shall be filed with the City Treasurer), who shall receive for the taking and filing each of said bonds twenty-five cents, to be paid by the officer executing the same. Auctions and Auctioneers. No. 6. (Original Series, No. 47) An Ordinance Relating to Auctions and Auctioneers. Be it ordained by the Mayor and Councilmen of the City of Troy: Sec. 1. Before any person shall proceed to sell at public auction, within the limits of the city of Troy, any merchandise of any class whatever, he shall first obtain a license for an auctioneer, and shall pay the sum of five dollars for each day of the continuance of such auction. Sec. 2. Any person desiring to exercise the office or calling of an auctioneer within this city, shall first obtain a license therefor, by paying into the city treasury the sum of ten dollars per year; provided, that a license may be granted to an auctioneer for a less time than one year, by the applicant paying one dollar per day for such license. Sec. 3. Any person convicted of carrying on an auction without license, in violation of the provisions of Section 1 of this ordinance, shall be fined not less than twenty-five dollars, nor more than fifty dollars, for each offense; and any person acting as an auctioneer without license, in violation of Section 2 of this ordinance, shall, on conviction, be fined not less than five dollars, nor more than twenty-five dollars, for each offense. Section 4 Sec. 4. Ordinances No. 22 and 23 in relation to auctions and auctioneers are hereby repealed. Section 5 Sec. 5. Attorney—City.No. 5. An Ordinance Relating to the Duties of the City Attorney. Be it ordained by the Mayor and Councilmen of the City of Troy: Sec. 1. It shall be the duty of the City Attorney to appear and prosecute or defend all actions which may be brought by or against the city, or in which the city may be interested; and he shall draft all ordinances, bonds, contracts, conveyances, and such other instruments of writing as may be required by the business of the city; he shall advise the City Council and all officers of the city upon such legal questions affecting the duties of their offices or the interests of the city, as may be submitted to him, furnishing written opinions when the same may be required; he shall also give his personal attention to, and prosecute, any and all violations of the ordinances of the city, and perform all other professional services incident to his office which may be required of him by the City Council. Section 2 Sec. 2. The City Attorney shall receive for his services to the City Council the sum of twenty-five dollars per year, payable quarterly, and such further sum as may be agreed upon between him and the Council, as fees in cases before any other tribunal than the court of the Police Judge; and for attendance at trials before said Judge, he shall receive $2.50 for each and every case, to be taxed as costs therein.  No. 4. An Ordinance in Relation to Certain Appropriations. Be it Ordained by the Mayor and Councilmen of the City of Troy: Sec. 1. There is hereby appropriated quarterly, out of the general fund of the City of Troy, an amount sufficient to pay the salaries of the officers of the City of Troy, as the same shall become due and payable, as provided by the ordinances creating such offices, or fixing the compensation thereof. Sec. 2. The mayor and clerk are hereby instructed to draw orders quarterly, and monthly where any officer is entitled by ordinance to be paid monthly, on the City Treasurer, to pay said salaries to the parties respectively entitled thereto. Before taking office, an appointee must: Receive a certificate of appointment. Take an oath to support the U.S. Constitution and the Constitution of Kansas. Faithfully perform the duties of the office. File any required bond with the city clerk. Original Ordinance No. 3 is repealed.

Addition to Troy No. 2 (Original Series, No. 43) An Ordinance Extending the Limits of the City of Troy Be it ordained by the Mayor and Councilmen of the City of Troy, Doniphan County, Kansas, as follows: Section 1. That the following described territory divided into lots, and lying adjacent to Troy aforesaid, to-wit: The northwest quarter of the northwest quarter of section 20, township 3, range 21, and so much of the northwest quarter of the northwest quarter of said section as is covered or included in Hayton’s Addition to the City of Troy aforesaid, are declared to be a part of the City of Troy, for all purposes whatever. Section 2: This ordinance shall take effect and be in force after its publication in the Doniphan County Republican, a newspaper published in Troy aforesaid. Approved February 21, 1874. Troy No. 1 An Ordinance Extending the Limits of the City of Troy Be it ordained by the Mayor and Councilmen of the City of Troy: Section 1 That the corporation of the City of Troy is hereby extended so as to include the following adjacent lands, to-wit: All that portion of the west half of the northeast quarter of Section No. twenty (20) in Township No. three (3) of Range No. twenty-one (21), lying north of the north line of the right-of-way of the Saint Joseph & Denver City Railroad Company, and included in Hayton’s Addition; and the said lands are hereby declared to be a part of the City of Troy, subject to all the laws of the city now in force, or that may be enacted by the Mayor and Council thereof. Ordinance No. 115 An ordinance levying a tax for the year 1902. Be it ordained by the Mayor and Council of the City of Troy, Kansas: Sec. I. That there is hereby levied on all the taxable real and personal property within the limits of the City of Troy a tax of two mills on the dollar for general purposes for the year 1902. Sec. II.
