CITY OF TROY, KANSAS ORDINANCE NO. 744   SPECIAL ASSESMENT TO CONSUMERS OF ELECTRIC ENERGY FURNISHED BY THE CITY OF TROY, PROVIDING FOR THE USE OF A POWER COST ADJUSTMENT FACTOR COMPUTING CHARGES FOR ELECTRIC ENERGY SOLD AND DELIVERED BY THE CITY OF TROY, PROHIBITING ANY TAMPERING WITH AN ELECTRIC METER, PROVIDING PENALTIES FOR VIOLATING CERTAIN PROVISIONS OF THIS ORDINANCE, PROVIDING FOR A DELINQUENT CHARGE AND FOR THE BILLING AND COLLECTION OF ELECTRICAL ENERGY CHARGES, PROVIDING FOR A SERVICE FEE APPLICABLE TO ALL USERS AND REPEALING CITY OF TROY ORDINANCE NO. 723 AND ALL OTHER ORDINANCES AND PARTS THEREOF IN CONFLICT HEREWITH.   BE IT ORDAINED BY AN ORDINANCE OF THE CITY OF TROY, KANSAS, FIXING CHARGES AND THE GOVERNING BODY OF THE CITY OF TROY, KANSAS:   SECTION 1.   From and after the passage of this ordinance and publication in the official city paper, the electric rates hereinafter set forth shall be in effect for all electric energy supplied to users thereof by the City of Troy, Kansas.   SECTION 2.   Electric service shall be furnished under rate schedules provided in this section to all domestic and commercial users whose usage of electricity is not measured by capacity meter and to users whose use of electricity is measured by a capacity meter but who are not subject to being assessed a capacity charge.   A Base monthly charge of $25.00 per month which base charge shall be assessed whether-or-not the customer consumes any electric energy.   for each KWH the sum of $.145 per KWH.     SECTION 3.   Electric service shall be furnished under rate schedules provided in this section to all domestic and commercial users within the city limits of the City of Troy, Kansas, whose usage of electricity is measured by a capacity meter, sometimes referred to as a demand meter and who is, according to the terms and provisions of this ordinance, subject to being billed a capacity charge.   SUMMER RATES:    Summer rates shall be utilized in connection with the billings which follow the meter readings in the months of July, August, and September.  Under summer rates each customer whose usage of electricity is measured with a capacity meter shall pay:   (1)        $0.23 per KW for the first 100 KWHS USED; and,   (2)        $0.1325 for the next 3,900 KWHs used; and   (3)        $0.0925 per KWH for all usage over 4,000 KWHs.   In addition to the KWH charges herein set forth each consumer whose usage of electricity is measured with a capacity meter and who uses 15.1 KWs or more shall pay a capacity charge of $18.24 per KW as measured by a fifteen-minute capacity meter and calculated as provided in Section 3C of this ordinance for all KWs in excess of 15.1.   WINTER RATES. NOW, THEREFORE, IT IS ORDAINED BY THE GOVERNING BODY OF THE CITY OF TROY, KANSAS, AS FOLLOWS: 1.  That the owner(s) of record of any real estate in the City of Troy, Kansas which has a zoning classification of B-1, B-2, B-3 or B-4 and abuts a sidewalk on public right-of-way, and the owner(s) of any real estate in the City of Troy abutting a sidewalk on public right-of-way on Poplar Street between Main Street and Park Street shall cause all snow and/or ice which has accumulated on that portion of said sidewalk abutting real estate owned by the property owner(s) to be removed therefrom within 12 hours from the time the storm causing the sidewalk to be snow and/or ice covered ends.  In the event snow and/or ice accumulates upon the sidewalks herein specified in the nighttime, removal of said snow and/or ice must be completed within 12 hours after sunrise. 2.  That the owner(s) of record of any real estate in the City of Troy which abuts any sidewalk on public right-of-way, excepting those sidewalks described in Section 1 above, shall cause all snow and/or ice which has accumulated on that portion of the sidewalk abutting real estate owned by the property owner(s) to be removed therefrom within 24 hours from the time the storm causing the sidewalk to be snow and/or ice covered ends.  In the event snow and/or ice accumulates upon the sidewalks referenced in this Section 2 in the nighttime, removal of said snow and/or ice

ORDINANCE NO. 747 AN ORDINANCE OF THE CITY OF TROY, KANSAS, ESTABLISHING RATES FOR USERS OF WATER, PROVIDING FOR TAPS AND CONNECTIONS TO THE CITY’S WATER MAINS AND ESTABLISHING THE RATES THEREFORE, PROVIDING FOR THE INSTALLATION OF WATER METERS AND FOR AN ACCOUNT PROCESSING FEE ASSOCIATED THEREWITH, PROHIBITING THE MAKING OF INSTALLATIONS, TAPS AND CONNECTION BY CERTAIN PERSONS, PROVIDING PENALTIES FOR VIOLATING CERTAIN PROVISIONS OF THIS ORDINANCE, FIXING DATES FOR THE PAYMENT OF WATER BILLS, PROVIDING FOR THE BILLING AND PAYMENT OF CHARGES, PROVIDING FOR THE IMPOSITION OF A DELINQUENCY CHARGE AND FOR THE DISCONTINUANCE OF WATER SERVICE FOR FAILURE TO PAY BILL, PROVIDING FOR AUTOMATIC FUTURE INCREASES TO RATES AND CHARGES, EFFECTIVE JANUARY 1, 2027, REPEALING ORDINANCE NO. 721 AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF TROY, KANSAS: SECTION ONE: From the effective date of this ordinance the rates and charges to users of water supplied by the City of Troy, Kansas, shall be as follows: (A) Each user of water having a water meter serving property situated entirely or partially within the limits of the City of Troy, Kansas, shall be assessed a monthly base charge of Thirty-one Dollars ($31.00) per water meter.  This base charge shall not entitle the user to or constitute payment for any water. (B) Each user of water having a water meter serving property situated entirely or partially within the limits of the City of Troy, Kansas, shall, in addition to the base charge provided for in sub-section (a) of this section pay for all water used at the rate of $.011 per gallon. (C) Each user of water having a water meter serving property situated entirely outside the limits of the City of Troy, Kansas, shall be assessed a monthly base charge of Forty-one Dollars ($41.00) per water meter.  This base charge shall not entitle the user to or constitute payment for any water. (D) Each user of water having a water meter serving property situated entirely outside the limits of the City of Troy, Kansas, shall, in addition to the base charge provided for in sub-section (c) of this section pay for all water used at the rate of $.013 per gallon. (E) Each user of water obtaining water directly from the City’s mains without the installation of the usual meter shall pay for such water at the rate of Twenty-Five Cents ($.25) for each fifty (50) gallons or fraction thereof. (F) All other users not included in sub-sections (A), (B), (C), (D) and (E) above obtaining water from the City of Troy, Kansas, shall pay for the same at the rate of $.013 per gallon.  This rate shall also be applicable to Rural Water District No. 5 of Doniphan County, Kansas, should it, be granted permission to obtain water from the City. CITY OF TROY, KANSAS ORDINANCE NO. 748 AN ORDINANCE OF THE CITY OF TROY, KANSAS, ESTABLISHING THE RATES TO BE CHARGED BY THE CITY OF TROY, KANSAS, TO USERS OF THE CITY’S WASTE WATER DISPOSAL SYSTEM, PROVIDING FOR CONNECTIONS TO THE SEWAGE DISPOSAL SYSTEM AND ESTABLISHING THE CHARGES THEREFORE, PROHIBITING THE MAKING OF CONNECTIONS TO THE SEWAGE DISPOSAL SYSTEM WITHOUT APPROVAL OF THE CITY AND PROVIDING PENALTIES FOR VIOLATING THE PROVISIONS HEREOF RELATIVE TO CONNECTIONS, REPEALING ORDINANCE NO. 724 AND REPEALING ALL OTHER ORDINANCES AND PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF TROY, KANSAS: ARTICLE I Unless the context specifically indicates otherwise, the meaning of terms used in this ordinance shall be as follows: SECTION 1.  BOD (denoting Biochemical Oxygen Demand) – the quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure in five (5) days at 20° C, expressed in milligrams per liter (mg/l). SECTION 2.  NORMAL DOMESTIC WASTEWATER – Wastewater that has a BOD concentration of not more than 250 mg/l and a suspended solids concentration of not more than 300 mg/l. SECTION 3.  RESIDENTIAL CONTRIBUTOR – Any contributor to the City=s  treatment systems whose lot, parcel of real estate, or building is used for domestic purposes only.  Each mobile home or apartment in a group of mobile homes or apartments shall be considered a residential contributor even if each mobile home or apartment is not served by individual water meters. SECTION 4.  SHALL is mandatory, MAY is permissive. SECTION 5.  SS (denoting Suspended Solids) – Solids that either float on the surface of or are in suspension in water, sewage, or other liquids and which are removable by laboratory filtering. SECTION 6.  TREATMENT SYSTEM – Any devices and systems for the storage, treatment, recycling, and reclamation of municipal sewage, domestic sewage, fall sewers, sewage collection systems, individual systems, pumping, power, and other equipment and their appurtenances; extensions, improvement, remodeling, additions and alterations thereof; elements essential and clear well facilities; and any works, including site acquisition of the land that will be an integral part of the treatment process or is used for ultimate disposal of residues resulting from such treatment (including land for composting sludge, temporary storage of such compost, and land used for the storage of treated wastewater in land treatment systems before land application); or any other method or system for preventing, abating, reducing, storing, treatment, separating, or disposing of municipal waste and sanitary sewer systems. SECTION 7.  WATER METER – A water volume measuring and recording device, furnished and/or installed by the City of Troy or furnished and/or installed by a user and approved by the City of Troy. SECTION TWO: All rates and charges referenced in Sections One and Three ofthis Ordinance shall automatically increase by three percent (3%) on January 1, 2023, and onJanuary1ofeachyearthereafter. No fewer than three copies of the Standard Traffic Ordinance shall be marked or stamped “Official Copy as Adopted by Ordinance No. 719”, and to which shall be attached a copy of this ordinance and filed with the City Clerk to be open to inspection and available to the public at all reasonable hours. The police department, municipal judge and all administrative departments of the City charged with enforcement of the ordinance shall be supplied, at the cost of the city, such number of official copies of the Standard Traffic Ordinance similarly marked, as may be deemed expedient. SECTION 2. AMENDMENT OF SECTION 33 OF THE STANDARD TRAFFIC ORDINANCE FOR KANSAS CITIES, EDITION OF 2020. Section 33 of the Standard Traffic Ordinance for Kansas Cities, Edition of 2020, is hereby amended to provide as follows: ASec. 33. Maximum Speed Limits. (a) Except as provided in subsections (b) and (c) and except when a special hazard exists that requires lower speed for compliance with K.S.A. 8-1557, and amendments thereto, the limits specified in this subsection or established as authorized by law shall be maximum lawful speeds, and no person shall operate a vehicle at a speed in excess of 20mph: (b) (1) The maximum speed limit for that portion of Locust Street between Last Chance Road and Third Street shall be 35 miles per hour; (2) The maximum speed limit for that portion of Locust Street between Third Street and the East City Limit of the City of Troy, Kansas shall be 45 miles per hour; (3) The maximum speed limit for that portion of Last Chance Road located within the corporate limits of the City of Troy, Kansas shall be 45 miles per hour. CITY OF TROY, KANSAS ORDINANCE NO. 718 AN ORDINANCE REGULATING PUBLIC OFFENSES WITHIN THE CORPORATE LIMITS OF THE CITY OF TROY, KANSAS; INCORPORATING BY REFERENCE THE “UNIFORM PUBLIC OFFENSE CODE FOR KANSAS CITIES, EDITION OF 2020; AMENDING SECTION 13.1 OF THE UNIFORM PUBLIC OFFENSE CODE FOR KANSAS CITIES, EDITION OF 2020; AND REPEALING ORDINANCE NO. 713 AND ALL OTHER ORDINANCES PREVIOUSLY ENACTED BY THE CITY OF TROY RELATIVE TO OFFENSES SPECIFICALLY SPOKEN TO IN THIS ORDINANCE. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF TROY, KANSAS: SECTION 1. There is hereby incorporated by reference for the purpose of regulating public offenses within the corporate limits of the City of Troy, Kansas, that certain code known as the “Uniform Public Offense Code”, Edition of 2020, prepared and published in book form by the League of Kansas Municipalities, Topeka, Kansas. No fewer than three copies of said Uniform Public Offense Code shall be marked or stamped “Official copy as adopted by Ordinance No. 718”, and to which shall be attached a copy of this Ordinance and filed with the City Clerk to be open to inspection and available to the public at all reasonable hours. SECTION 2. Section 13.1 of the aforesaid Uniform Public Offense Code is hereby amended to provide as follows: APPLICATION; KANSAS CRIMINAL CODE AND LAWS, RULES AND REGULATIONS OF KANSAS DEPARTMENT OF WILDLIFE AND PARKS. The provisions of the Kansas Criminal Code (K.S.A. Supp. 21-5101 through K.S.A. Supp. 21-6712 inclusive and amendments thereto) and the provisions of K.S.A. 32-1011 declaring certain acts to be unlawful, which are in their nature applicable to the jurisdiction of the city and in respect to which no special provision is made by ordinance of the City are applicable to this Uniform Public Offense Code.@ SECTION 3. (a) Except as authorized by the Uniform Controlled Substances Act under state law, it shall be unlawful for any person to possess or have under such person’s control (1) Any depressant designated in subsection (e) of K.S.A. 65-­4105, subsection (e) of K.S.A. 65-4107, subsection (b) or (c) of K.S.A. 65-4109 or subsection (b) of K.S.A. 65-4111, and amendments thereto; (2) Any stimulant designated in subsection (f) of K.S.A. 65-4105, subsection (d) (2), (d) (4) or (f) (2) of K.S.A. 65-4107 or subsection (e) of K.S.A. 65-­4109, and amendments thereto; (3) Any hallucinogenic drug designated in subsection (d) of K.S.A. 65-4105 and amendments thereto or designated in subsection (g) of K.S.A. 65-4107 and amendments thereto or designated in subsection (g) of K.S.A. 65­4109 and amendments thereto; (4) any substance designated in subsection (g) of K.S.A. 65-4105, and amendments thereto, and designated in subsection (c), (d), (e), (f) or (g) of K.S.A. 65-4111 and amendments thereto; or (5) any anabolic steroids as defined

CITY OF TROY,KANSAS ORDINANCE NO. 717 AN ORDINANCE OF THE CITY OF TROY, KANSAS, FIXING CHARGES AND SPECIAL ASSESSMENT TO CONSUMERS OF ELECTRIC ENERGY FURNISHED BY THE CITY OF TROY, PROVIDING FOR THE USE OF A POWER COST ADJUSTMENT FACTOR COMPUTING CHARGES FOR ELECTRIC ENERGY SOLD AND DELIVERED BY THE CITY OF TROY, PROHIBITING ANY TAMPERING WITH AN ELECTRIC METER, PROVIDING PENALTIES FOR VIOLATING CERTAIN PROVISIONS OF THIS ORDINANCE, PROVIDING FOR A DELINQUENT CHARGE AND FOR THE BILLING AND COLLECTION OF ELECTRICAL ENERGY CHARGES, PROVIDING FOR A SECURITY DEPOSIT PRIOR TO THE FURNISHING OF ELECTRICAL SERVICE, PROVIDING FOR THE APPLICATION OF THE ELECTRICAL SECURITY DEPOSIT TO THE SATISFACTION OF UNPAID ELECTRIC UTILITY ACCOUNTS, AND REPEALING CITY OF TROY ORDINANCE NO. 704 AND ALL OTHER ORDINANCES AND PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OFTROY,KANSAS: SECTION 1. From and after the passage of this ordinance and publication in the official city paper, the electric rates hereinafter set forth shall be in effect for all electric energy supplied to users thereof by the City of Troy, Kansas. SECTION 2. Electric service shall be furnished under rate schedules provided in this section to all domestic and commercial users whose usage of electricity is not measured by capacity meter and to users whose use of electricity is measured by a capacity meter but who are not subject to being assessed a capacity charge. A. SUMMER RATES: Summer rates shall be utilized in connection with the billings which follow the meter readings in the months of July, August and September. Under summer rates, each customer shall pay: (1) $0.2022 per KWH for the first 100 KWHs used; and (2) $0.1217 per KWH for all additional KWHs used (above 100 KWHs). B. WINTER RATES: Winter rates shall be utilized in all months not subject to summer rates. Under winter rates, each customer shall pay: (1) $0.2022 per KWH for the first 100 KWHs used; and, (2) $0.1217 per KWH for the next 650 KWHs used (101 to 750 KWH); and (3) $0.0647 per KWH for all additional KWHs used (above 750 KWH). All users billed pursuant to Section 2 hereof shall pay, as their monthly bill, such amount as is due in accordance with the rates stated in said section or the sum of $10.54, whichever is greater. This provision regarding the payment of a minimum monthly bill of $10.54 shall be applicable under both summer and winter rates. SECTION 3. Electric service shall be furnished under rate schedules provided in this section to all domestic and commercial users within the city limits of the City of Troy, Kansas, whose usage of electricity is measured by a capacity meter, sometimes referred to as a demand meter and who is, according to the terms and provisions of this ordinance, subject to being billed a capacity charge.
