Troy City Council met on July 21, 2020, in regular session at Troy City Hall.  Mayor Sarah Boeh-Cerra called the meeting to order at 6:31 p.m.  Council members Cody Miller, Tim Hanlan, Nicholas Popple, Stan Ruhnke, Michael Brissett, City Attorney Alan Boeh, and City Clerk Jane Boeh were present.  Others present for a portion of the meeting were Police Chief Doug Duncan, Ambulance Director Matt McKittrick, Assistant Ambulance Director Tanner Veach, Working Supervisor Jim Horner, Kelly Blanton, Cully Clary, Betsy Hinds, Mindy Masters, Dennis McKittrick, Bill Penny, Terri Shelton, Cody Shelton, Mickayla O’Hart, Billy Jack O’Hart, Susan Reynolds, Linda Schultz, Kari Winder, Brittany Clary, Lacy Jasper, and Bob Klaus.  A zoom invitation for Shelly Underwood with Midwest Assistance Program, Brian Kingsley, Jared Mann, and Paul Owing with BG Consultants were all present not in person but by zoom.

 

A public hearing was held in accordance with a notice published on June 4, 2020 in the Kansas Chief, relating to a proposed load in an amount not to exceed $400,000.00 to be taken by the City from the Kansas Public Water Supply Loan Fund administered by the Kansas Department of Health and Environment.  Proceeds of the Loan would be used by the City to finance certain modifications and improvements to the City’s water supply and distribution system.

 

The Mayor informed those present of the issues involved in the Governing Body makings a decision whether to proceed with the Loan process, including entering into a loan agreement with KDHE to fund the project.  Information regarding the scope of the project, the proposed Loan repayment terms, the consultants to the City.  KDHE will no longer allow sludge created by backwashing at the water plant to get in the water stream.  We have to build 2 lagoons which requires land acquisition but this is the cheaper way to go.  KDHE has approved the preliminary engineering report.  Next step is the apply for a water pollution control permit application for wastewater discharges form potable water treatment plant but city needs to do water test first and to acquire the necessary land for the project.

 

Members of the public were permitted to make statements and ask questions of the Governing Body and the City’s consultants.  After all present were given an opportunity to speak and ask questions, the Mayor closed the public hearing.

 

The matter of proceeding with the application process came on for consideration and was discussed.  Thereupon, Councilmember Hanlan presented and moved to adopt Resolution 2020-8 authorizing the completion of an application to the Kansas Department of Health and Environment regarding a loan from the Kansas Public Water Supply loan fund…pursuant to K.S.A. 65-163c et seq…loan in an amount not to exceed $400,000.00 to finance the Project. Councilmember Brissett seconded the motion and it carried.  Application deadline is November 16 which Underwood will have done shortly.  BG Consultants will check on a 30% forgiveness and if we purchase the required land will city be able to be reimbursed with the loan.  The zoom meeting ended.

 

Hanlan moved to approve minutes as written for July 7, 2020.  Ruhnke seconded the motion and it carried.

 

Hanlan moved to approve bills Check #11851 to #11881 in the amount of $78,397.71.  Miller seconded the motion and it carried.

 

Mindy Masters was present to discuss her street getting to high and running water towards her house due to oil and chat over the years.  Council agreed City Superintendent is to look at street and see about adding drainage.

 

Betsy Hinds on behalf of the park board are asking for a speed bump on Park Street and rebuild the 2 on Myrtle Street to slow down traffic especially on Park Street by fence.  Horner will look at but if you put a speed bump on Park it may run water right into the new play ground equipment and mulch.  Thru the park is posted 10 m. p. but people are not observing the speed limit and are going faster.

 

A group a people were in wanting a noise ordinance.  It was determined the mater was a civil matter.

 

Ruhnke moved to pass zoning permit 2020-22 for an in-ground pool, retaining wall and fence at 510 W. Walnut.  Hanlan seconded the motion and it carried.

 

Ruhnke moved to pass zoning permit 2020-23 for a 12 x 21 open carport at 517 W. Jones.  Hanlan seconded the motion and it carried.

 

Miller moved to pass Resolution 2020-7 authorizing the issuance of a special event retailers’ permit to sell and serve cereal malt beverage on August 8, 2020 from 11 a.m. to 11:59 p.m. at 4-H grounds by Kelli Rodgers, Manager of Rookies Sports Bar & Grill and thus approving the special permit 2020-1 Cereal Malt Beverage License.  Hanlan seconded the motion and it carried.

 

 

 

 

 

 

Ruhnke moved to approve Doniphan County Sub-Recipient Coronavirus Relief Fund Resolution.  Brissett seconded the motion and it carried.

 

Popple moved to approve the engagement letter for 2020 audit with Gordon CPA   Hanlan seconded the motion and it carried.

 

Horner stated the need to get bids on 11 tires for equipment.  Council said to get.

 

The alley between Main and Seneca and Popular and State washed out pretty good on South end.  Horner is to get a price of tubes/rock needed to improve alley at next meeting.

 

Popple moved to approve a new 2” water meter for grade school at a cost of $1,909.00 plus labor and get in before school starts and plan on doing the high school next year.  Hanlan seconded the motion and it carried.

 

It was stated we drained the tower due to lack of chlorine due to the heat. 

 

Ambulance was discussed in regards to shortage of volunteers to keep the service manned 24/7 as required by the state.  Discussion was tabled to next meeting.

 

Council agreed to have 2021 budget published and hearing is set for August 18.

 

Ruhnke moved to adjourn at 9:20 p.m.  Miller seconded the motion and it carried.
