Troy City Council met at Troy City Hall on HApril 7, 2020 in regular session via zoom video conference.  City Clerk Jane Boeh was personally present at Troy City Hall.  Also present at City Hall was Liessa Long.  Mayor Sarah Boeh-Cerra, called the meeting to order at 6:39 p.m.  Council members Carolyn Clary, Nicholas Popple, and Cody Miller, City Attorney Alan Boeh, Stan Jones, municipal advisor, with firm of Stifel, Nicolaus & Co., Inc., City Superintendent Jim Horner, and Police Chief Doug Duncan were present via zoom.

 

Clary moved to approve amendment to minutes for March 3, 2020 regarding bills paid by check #11576 to 11603 in the amount of $25,046.06.  Miller seconded the motion and it carried.

 

Clary moved to approve minutes for March 17, 2020 as written.  Popple seconded the motion and it carried.

 

Popple moved to approve minutes for March 25, 2020 special meeting as written.  Clary seconded the motion and it carried.

 

Councilman Tim Hanlan connected to the meeting via zoom at 6:43 p.m.

 

Hanlan moved to approve bills check #11636 to 11673 and 11680 in the amount of $88,260.53.  (Checks #11674 to 11679 were voided due to printing error.)  Clary seconded the motion and it carried.

    

Miller moved to approve zoning permit 2020-5 for a 10 x 12 portable storage shed at 213 N Centre.  Popple seconded the motion and it carried.

 

Clary moved to table zoning permit 2020-6.  Need to let applicant know they need a variance from the 20’ set back on Park Street so they can place a fence 12’ from house.  Hanlan seconded the motion and it carried.

 

Horner explained the booster pump pull and inspection.  Popple moved to spend $4,615.00 per contract with Layne Christensen Company to pull, clean, etc. pump at booster station.  Hanlan seconded the motion and it carried.

 

Councilman Stan Ruhnke connected via zoom to the meeting at 7:10 p.m.

 

Clary moved to have the rest of the digger truck repairs done per bid.  Miller seconded the motion and it carried.

 

Stan Jones, municipal advisor reported on the bids received from Exchange Bank (net interest cost 2.94%) and First Option Bank (net interest cost 2.75%) in regards to the General Obligation Bonds for 10 years being used for electric upgrade.  First Option had the low interest bid. The average yearly payment is just under $79,000 with high being $81,000 and low $77,000 which requires payment of $6,700 monthly.  These upgrade costs must ultimately be passed on to electric utility customers. 

 

Clary moved to pass Ordinance 716 authorizing the issuance and delivery of $685,000 principal amount of general obligation bonds, series 2020A, providing for the levy and collection of an annual tax for the purpose of paying the principal and interest on said bonds as they become due; and making certain covenants with respect thereto.  Popple seconded the motion and it carried.

 

Clary moved to pass Resolution 2020-3  authorizing the issuance of $685,000 principal amount of the general obligation bonds, Series 2020A; providing for the levy and collection of an annual tax for the purpose of paying the principal of and interest on said bonds as they become due; prescribing the form, details and authorization of the delivery of said bonds; and, making certain covenants with respect thereto.  Hanlan seconded the motion and it carried.

 

Popple moved to have the mayor sign on behalf of the city a bond purchase agreement with First Option Bank.  Hanlan seconded the motion and it carried.

 

Council was advised Dustin Ferris has filed Chapter 13 bankruptcy.

 

Miller moved to pass resolution 2020-5 acknowledging the COVID-19 pandemic; acknowledging a state of disaster emergency in the State of Kansas; acknowledging Governor’s executive order 20-16; acknowledging Kansas supreme court administrative order 2020-PR-31; and temporarily closing the Troy Municipal Court.  Popple seconded the motion and it carried.

 

 

 

 

 

 

 

 

Clary moved to pass resolution 2020-4 declaring a local state of emergency; temporarily expanding the authority of the Mayor to act on behalf of the City of Troy; and ratifying previous decisions regarding the COVID-19 emergency.  Miller seconded the motion and it carried. 

 

Discussion was then had regarding water project and the possibility of postponing such for a while due to the COVID-19 effect on economy and community. 

 

Duncan stated he was provided with personal protection equipment at a meeting with law enforcement.  He feels the community is following recommendations of the health department in regards to COVID-19 for their safety and the safety of others.

 

The council was provided with a copy of the executive order no. 20-18 issued by Governor Laura Kelly regarding staying home and no groups bigger than 10 people.

 

Hanlan moved to allow the Troy Lions Club to use the community building parking lot for Easter Candy drive thru Saturday April 11, 2020, 10 a.m. to 2 pm.  Ruhnke seconded the motion and it carried. 

 

Ruhnke moved that a resident concerned about the safety of children playing in their driveway could purchase Children at Play signs and put them on their property adjacent to Last Chance Road.  Hanlan seconded the motion and it carried.

 

City Clerk is to take bids on a new furnace for City Hall Office so it can be put in before winter.

 

Accident and damage to well house was discussed.  Council was informed city deductible is $1,000.00.  City Superintendent is to get a price to repair the building.

 

Clary moved to go into executive session at 8:20 p.m. for 10 minutes to discuss personnel with council members, Mayor, City Clerk, City Superintendent, and City Attorney present.  Liessa Long left the meeting and Police Chief responded to a call and unhooked from zoom conference.  Hanlan seconded the motion and it carried.

 

Meeting reconvened at 8:28 p.m.

      

Clary moved to adjourn at 8:30 p.m.  Hanlan seconded the motion and it carried.
