CITY OF TROY, KANSAS ORDINANCE NO. 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any accumulation of snow and/or ice upon sidewalks on public right-of-way which is not promptly removed therefrom presents a danger to all persons utilizing said sidewalks. NOW, THEREFORE, IT IS ORDAINED BY THE GOVERNING BODY OF THE CITY OF TROY, KANSAS, AS FOLLOWS: 1.  That the owner(s) of record of any real estate in the City of Troy, Kansas which has a zoning classification of B-1, B-2, B-3 or B-4 and abuts a sidewalk on public right-of-way, and the owner(s) of any real estate in the City of Troy abutting a sidewalk on public right-of-way on Poplar Street between Main Street and Park Street shall cause all snow and/or ice which has accumulated on that portion of said sidewalk abutting real estate owned by the property owner(s) to be removed therefrom within 12 hours from the time the storm causing the sidewalk to be snow and/or ice covered ends.  In the event snow and/or ice accumulates upon the sidewalks herein specified in the nighttime, removal of said snow and/or ice must be completed within 12 hours after sunrise. 2.  That the owner(s) of record of any real estate in the City of Troy which abuts any sidewalk on public right-of-way, excepting those sidewalks described in Section 1 above, shall cause all snow and/or ice which has accumulated on that portion of the sidewalk abutting real estate owned by the property owner(s) to be removed therefrom within 24 hours from the time the storm causing the sidewalk to be snow and/or ice covered ends.  In the event snow and/or ice accumulates upon the sidewalks referenced in this Section 2 in the nighttime, removal of said snow and/or ice

CITY OF TROY, KANSAS ORDINANCE NO. 744   SPECIAL ASSESMENT TO CONSUMERS OF ELECTRIC ENERGY FURNISHED BY THE CITY OF TROY, PROVIDING FOR THE USE OF A POWER COST ADJUSTMENT FACTOR COMPUTING CHARGES FOR ELECTRIC ENERGY SOLD AND DELIVERED BY THE CITY OF TROY, PROHIBITING ANY TAMPERING WITH AN ELECTRIC METER, PROVIDING PENALTIES FOR VIOLATING CERTAIN PROVISIONS OF THIS ORDINANCE, PROVIDING FOR A DELINQUENT CHARGE AND FOR THE BILLING AND COLLECTION OF ELECTRICAL ENERGY CHARGES, PROVIDING FOR A SERVICE FEE APPLICABLE TO ALL USERS AND REPEALING CITY OF TROY ORDINANCE NO. 723 AND ALL OTHER ORDINANCES AND PARTS THEREOF IN CONFLICT HEREWITH.   BE IT ORDAINED BY AN ORDINANCE OF THE CITY OF TROY, KANSAS, FIXING CHARGES AND THE GOVERNING BODY OF THE CITY OF TROY, KANSAS:   SECTION 1.   From and after the passage of this ordinance and publication in the official city paper, the electric rates hereinafter set forth shall be in effect for all electric energy supplied to users thereof by the City of Troy, Kansas.   SECTION 2.   Electric service shall be furnished under rate schedules provided in this section to all domestic and commercial users whose usage of electricity is not measured by capacity meter and to users whose use of electricity is measured by a capacity meter but who are not subject to being assessed a capacity charge.   A Base monthly charge of $25.00 per month which base charge shall be assessed whether-or-not the customer consumes any electric energy.   for each KWH the sum of $.145 per KWH.     SECTION 3.   Electric service shall be furnished under rate schedules provided in this section to all domestic and commercial users within the city limits of the City of Troy, Kansas, whose usage of electricity is measured by a capacity meter, sometimes referred to as a demand meter and who is, according to the terms and provisions of this ordinance, subject to being billed a capacity charge.   SUMMER RATES:    Summer rates shall be utilized in connection with the billings which follow the meter readings in the months of July, August, and September.  Under summer rates each customer whose usage of electricity is measured with a capacity meter shall pay:   (1)        $0.23 per KW for the first 100 KWHS USED; and,   (2)        $0.1325 for the next 3,900 KWHs used; and   (3)        $0.0925 per KWH for all usage over 4,000 KWHs.   In addition to the KWH charges herein set forth each consumer whose usage of electricity is measured with a capacity meter and who uses 15.1 KWs or more shall pay a capacity charge of $18.24 per KW as measured by a fifteen-minute capacity meter and calculated as provided in Section 3C of this ordinance for all KWs in excess of 15.1.   WINTER RATES.
